TO CLOSE PINE VIEW AVENUE <br /> <br /> This Cause, coming on to be heard at a regular meeting of the Board of County <br />Commissioners of Cabarrue County, N.C., on November 7, 1955, on the Petition of the Church of God <br />O~phanage and Children's Home of North Carolina, Inc., and being heard by the Board of County <br />Commissioners ~of Cabarrus County, N.C., and the Board finding as a fact that the petitioner is <br />the owner and is in possession of a tract of land on the North side of Pine View Avenue in Block <br /> <br />M of Section 4 of the B. L. Umberger Estate and of a tract of land on the South side of Pine View <br />Avenue, which tract is a part of the homeplace of Sam W. Cook, and that both tracts extend along <br />Pine View AVenue from S~hadybrook Road to Walnut (or Judas) Avenue; that Pine View Avenue wasnot <br />shown on the original map of the B. L. Umberger Estate but is mentioned as a street or road in <br />deeds for Meeperty along the Cook-Umberger line and lying between Shadybrook Road and Walnut <br />(or Judas) Avenue; that all property on both sides of Pine View Avenue belongs to the Church of <br />God O~phanage and Children's Home of NOrth Carolina, EXne., and that the~e are no rights-of-way <br />leading from Pine View Avenue acroes the property of the Church of God Opphanage and Children's <br />Home of North Carolina, Inc., to the property of any other person, firm or corporation; that Pine <br />View Avenue is only one block in length; that i~ has never bben opened as a public street or road, <br />nor has it been accepted by the State Highway and Public Works Coe~ission for maintenance; that <br />its closing is not contrary to the public interest and no individual owning l~operty in the vicinit <br />of said street or road or ~in the subdivision in which it is located will thereby be deprived of <br />reasonable means of ingress or egreem to hie property; that the petitioner is a charitable <br />organization engaged in the care, nurture ar~ education of orphans and needy children whose <br />welfare and safety it desires to ~otect; that for the proper administration of the duties Which <br />the petitioner has assumed it is for the best interest of the petitioner that the street o~ road <br />be closed; that the closing of said street or road will contribute ~aterially to the safety of <br />the children in the orphanage and children's home and will enhance the recreational facilities at <br />their disposal; that it will not be detrimental to the proper enjoyment of their of their property <br />by persons who own p~operty in the B. L. Umberger Es tare nor in the surro~mdi~ area, and that the <br />petitioner has caused to be published in the Kannspolis Independent on October 6, October 13, <br />October 20 and October 27, a notice of its intention to file this date its petition for the <br /> <br />closing of Pine View Avenue; <br /> <br /> And the Board further finding as a fact that no person, firm, or corporation appeared <br /> <br />in person or by attorney, nor did anyone appear as the representative of a group to oppose the <br />closing of Pine View AYenue. <br /> <br /> It is, Therefare, on motion of P.E~nest Stallings, seconded by W.Frank McCray, and <br />carried by unaminous vote, ordered, and adjudged that Pine View Avenue shall be and re~ain forever <br />closed as a public street or road. <br /> <br /> Witnese our hands and t he corporate seal of Cabarrus County, North CarOlina, the day <br /> <br />and year first above written.= <br /> J.
