A~ a special meeting of the Board of Cabarrus County Commissioners pertaining to the <br /> <br /> Sanitary District in Cabarrus County held on August 26, 1958 at h:O0 o'clock P. M. at the <br /> <br /> Educational Building of the $outhside BaptistChurch, near Concord, North 5~rolina , there <br /> <br /> was no opposition to the hearing. <br /> ,, <br /> <br /> The Board of Commissioners for the County of Cabarrus, North Carolina, pursuant to <br /> <br /> adjournment, met at h:O0 o'clock, P M. Tuesday,August 26, 1958, at the Educatioaal Building of <br /> <br /> the Southside Baptist Chuxch, near Concord, North Carolina . <br /> <br /> Present: M.S. Lyles, acting Chairman, and Commissioners W. Guy Isenhour and P.E.Stallings. <br /> Absent: W.Frank McCray andBowman Barrier. <br /> <br /> Also present: Marshall Starch representing the North Carolina State Board of Health. <br /> <br /> ~A t the hour of h:O0 o'clock, P. M. i+s Chairman announced that, pursuant toa notice <br /> duly posted and published ,this was the date and hour fixed bythe Board of Commissioners and the <br /> State Health Director of the North ~arolina State Board of Health for the joint public hearing <br /> upon a petition filed with the Board of Commissioners forthe County of Cabarrus on July 7, 19~8 <br /> proposing ~he creation of a sanitary district in Cabarrus County. <br /> The Chairman announced that the Board of Commissioners and~be representative of the <br /> ~tate Board of Health would immediately hear any andall freeholders and other interested persons <br /> concerning the creation of the proposed sanitary district. <br />.~i Mr. Marshall Starch, representative of the State Board of Health, explained the petition <br /> and what it called for. He then asked if there was anyone desiring to speak in favor of the <br /> petition. No one spoke for the petition but several persons had questions concerning the <br /> proposed sanitary discrict. These questions were answered by Mr. Paul VanCamp,Engineer. Mr. <br /> Starch, after giving opportunity for all in favor to speak if they so desired, called forany <br /> ppposition. No one spoke in opposition of the petition. Mr Stat0n then asked if those present <br /> were in favor of the proposed sanitary distraict. Those people present indicated that they <br /> favored the creation of the district. There were forty-two (h2) persons in attendance. <br /> No freeholder or other interested person~appeared, either in person or by attorney, to <br /> protest against the creation of the proposed sanitary district, m~d the Clerk Announce~ that no <br /> protest in writing~ s~gned by any freeholder or other interested person, had been presented. <br /> Thereupon Commissioner W.Guy Isenhour introduced th~' following resolution which was read: <br /> RESOLUTION CONCERNING CREATION OF A SANITARY DISTRICT IN <br /> CABARRUS COUNTY <br /> WHEREAS, a petition proposing the creation of a sanitary district in Cabarrus County <br />~-~ .z was filed with the Board of Commissioners on July 7, 1958, which petition is set forth in the <br /> minutes of theAugust h, 1958 meeting of said Board, and is a s follows: <br /> <br /> PETITION FOR CREATION OF <br /> SANITARY DISTRICT <br /> <br /> We, the undersigned freeholders within the boundaries of the territory described below <br /> respectfully petition the Board of Commissioners for the County of Cabarrus, '~orth Carolina, to <br /> take all necessary action required by Article 12 of Chapter 130 of the General Statutes of North <br /> Carolina for the creatiOn of a sanitary district comprising such territory, the objects proposed <br /> to be accomplished by the nzeation of such district being the acquisition, construction, maintenan e <br /> and operation of a water supply and distribution system, a sewerage system, sewage disposal or <br /> treatment plant, providing adequate fire protection facilities, and such other utilities as may <br /> be.necessary for the preservation and promotion of the public health and sanitary welfare <br /> <br /> <br />
