431 <br /> <br /> The Cabarrus County Commissioners met at a call meeting Friday, Feb- <br />ruary 18, 1966, at ~2:00 p.m. at the Courthouse. <br />Present: Chairman, C. Frank James <br /> <br /> Commissioners, McNeil Petrea, Smoot Lyles, Frank McCray <br />Absent: Commissioner, Oren Hill <br /> <br /> Meeting called to order by Chairman James. Mr. Kulis of American Air <br />Surveys was present to discuss the liquidated damage clause in the contract with <br />county. He requested the county to exempt his company from this clause. He also <br />requested his performance bond be released. <br /> <br /> Lyles made motion, seconded by McCray to accept the work and release the <br /> Performance Bond, by American Air ~rveys, Inc., but subject to the withholding <br /> of a sum of $6900. which represents a 43 day late delivery and that the balance <br /> of the retainage fee less the above stated sum be paid to American Air Surveys, <br /> Inc.; that a 30 day period be allowed in which Cabarrus County officials can <br /> negotiate with American Air Surveys as to the possibility of a settlement or <br /> arbitration as to the amount to be retained by the county under paragraph 4 of <br /> <br /> the contract under section "Compensation and Terms". <br /> Voted for: James, Petrea, Lyles, McCray <br /> Voted against: none <br /> <br /> Having no further business, meeting adjourned. <br /> <br /> <br />
