NORTH CAROLINA <br /> PETITION <br />CABARRUS COUNTY <br /> <br />In the Matter of: <br /> <br /> Closing of Crenshaw Street ) <br /> (formerly known as Dallas Avenue) ) <br /> and Marietta Street in Kannapolis, ) <br /> Number Four Township ) <br /> ) <br /> <br />To the Board of Commissioners of Cabarrus County: <br /> <br /> WHEREAS, pursuant to the provisions of North Carolina <br />General Statutes Section 136-63, the State Highway Commission <br />has abandoned Crenshaw Street (formerly known as Dallas Avanue <br />and formerly designated as Secondary Road No. 2133); and no part <br />of said street (always meaning street or road) is any longer <br />under the control and supervision of the State Highway Commission; <br />and <br /> <br /> WHEREAS Marietta Street (also sometimes known as <br /> <br />Crenshaw Street) and a portion of Crenshaw Street have never <br /> <br />been opened and used by the public as a street; and <br /> <br /> WHEREAS both of said streets in their entirety are shown <br />on the map of "Crainshaw Heights", a map of said subdivision being <br />on file in Map Book 3 at page 34 in the office of the Register of <br />Deeds, a copy of which subdivision map is attached hereto and <br />made a part of this Petition (a copy of the Cabarrus County Tax <br />Map is also attached hereto for reference); and <br /> <br /> WHEREAS the undersigned Petitioners are all of the owners <br />of the property adjoining and/or served by said two streets; and <br /> <br /> WHEREAS Petitioners desire that said two streets be <br /> <br />closed in order that Petitioners may sell their adjoining properties <br />to a firm which plans to construct a large business enterprise <br />upon the property and the closing of said streets is essential to <br />the location of the buildings upon the property; <br /> <br /> NOW THEREFORE the undersigned Petitioners respectfully <br />request that the Board of Commissioners order the closing of said <br />two streets pursuant to North Carolina General Statutes Section <br />153-9 (17). <br /> <br /> <br />
