The Cabarrus County Commissioners met at a call meeting Wednesday, <br /> <br />August 21, 1968, at 7:30 P.M. ~t the Courthouse. Present were: <br /> Chairman - C. Frank 3ames <br /> <br /> Commissioners - C. McNetl Petrea, {;. Glenn Hawfteld, Jr. <br /> <br /> and Dr. R. B. Rank/n, Jr. <br /> <br /> Absent -F. J. Beasley, Jr. '. <br />Chairman James called the meeting to order. <br /> <br /> County Attorney James C. Darts discussed w/th the Board the matter of <br />American Air Survey's lawsuit concerning the balance of $6900.00 in dispute <br />between the County and American Air. Survey. Attorney Davis explained that the <br />Supreme Court has held that the penalty claase in a contract for work unfinished <br />as of contract termination date could not be held valid if no damages were <br />sustained. Attorney Davis stated that the County suffered no damage as a result. <br />of the American JCir Survey not completing on date specified in the contract. <br />A motion to authorize Attorney James Davis to make a settlement out of court <br /> <br />on this matter was made by Rankin, seconded by Petrea. Voted for - Rankin and <br />Petrea. Voted against - Hawfield. <br /> <br /> Having no further busir~ess, meeting adjourned. <br /> <br /> Clerk to Board <br /> <br /> <br />
