295 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in special session at the Courthouse <br /> <br /> in Concord, North Carolina on Thursday, July 25, 1974, at 11:00 a.m. <br /> <br /> Present - Chairman: S. Glenn Hawfield, Jr. <br /> <br /> Commissioners: Robert A. McClary <br /> Charles Gallimore <br /> C. Frank James <br /> John A. Hammett <br /> <br /> Attorney, John Boger, stated what action several other counties who had rock concerts had <br /> <br />taken to prevent their reoccurrence. Attorney Boger stated that there are two courses of action <br />open to the Board: (1) Draw up an ordinance that would require the promoter to secure a license <br />and meet certain standards. He felt that an ordinance prohibiting rock concerts would be determined <br />unconstitutional in court. (2) The Board could go to court to seek an injunction. <br /> <br />Attorney Pat Taylor Stated that he was representing the promoters of the rock concert. <br />Bobby Batson, Public Relations Director for the Charlotte Motor Speedway, stated that <br />according to his records, only three people had been admitted to Cabarrus Memorial Hospital during <br />the last race at the speedway. <br /> <br /> Commissioner McClary made motion, seconded by Commissioner James and unanimously carried, to <br /> <br />go into executive session. <br /> <br /> After a brief executive session, Chairman Hawfield reconvened the meeting. <br /> <br /> The following resolution was introduced and moved for adoption by Commissioner McClary and <br />seconded by Commissioner Hammett: <br /> <br /> WHEREAS, the Board is informed that a group of persons and firms propose <br /> <br /> to sponsor an event in Cabarrus County known as a "rock concern" on the 10th <br /> <br /> of August,1974; and <br /> <br /> WHEREAS, it is understood that at said rock concert there will be in <br /> <br /> attendance from 100,000 to 250,000 persons which would require the furnishing <br /> by local persons and authorities of enormous manpower to provide sanitary <br /> facilities, medical facilities, traffic control, law enforcement and other <br /> services; and <br /> <br /> WHEREAS, the Board ls informed that said concerts have been held in other <br /> <br /> counties in North Carolina resulting in great discomfort, inconvenience and <br /> <br /> expense to the local government and the local community; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that this Board consider such an event to <br /> <br /> be a nuisance wherein great expense, inconvenience and discomfort and perhaps <br /> damage to persons and property may be visited upon local citizens and that, <br /> therefore, it is not in the best interest of Cabarrus County that such an event <br /> be held within the County and the Board hereby instructs the County Attorney to <br /> take legal action to request the Court that the promoters of said event be enjoined <br /> from having said event in Cabarrus County. <br /> <br />Vote unamimously carried. <br /> <br /> Having no further business, meeting adjourned. <br /> <br /> <br />
