237 <br /> <br />bond by a surety company as herein provided the <br />franchisee may file and deposit with the County <br />a performance bond without a corporate surety <br />but secured by a Certificate of Deposit in <br />some bank or savings and loan association in <br />Cabarrus County, North Carolina, in the sum of <br />$100,000o00 conditioned in the same manner as <br />the performance bond of a surety company herein- <br />before described. The income from such deposit <br />shall be payable to the franchisee. As an <br />alternative the franchisee may provide such <br />other security as may be approved by the Board <br />of Commissioners, but absent such approval it <br />shall provide a bond or deposit in lieu thereof <br />as above provided. <br /> <br />10o System Design Provisions. <br /> 10.1 EmergencM Override: <br /> <br /> The cable system shall in- <br />clude an "Emergency Alert" capability which will <br />permit' the Chairman or his designee to override, <br />by remote control, the video and/or audio of all <br />channels simultaneously programming in the case of <br />public emergencies. The franchisee shall de- <br />signate a channel which will be used for emer- <br />gency broadcasts. <br /> <br />10.2 <br /> <br />~Standby Power: The franchisee shall maintain <br />equipment capable of providing standby powering <br />for headend. The equipment shall be constructed <br />so as to notify automatically the cable office <br />when it is in operation and to revert auto- <br />matically to the standby mode when the AC power <br />returns. <br /> <br />10.3 <br /> <br />S~stem Standards: The franchisee shall install <br />and maintain a cable system which shall be in <br />accordance with the highest and best accepted <br />standards of the industry to the end that sub- <br />scribers shall receive the best possible service. <br />In addition, the franchisee shall comply with all <br />requirements of all duly constituted regulatory <br />agencies having jurisdiction over cable televi- <br />sion or the operator of the cable system. <br /> <br />10.4 <br /> <br />System Carriage: At all times the signal carriage <br />and channel utilization shall conform to the <br />regulations of the FCC, state and other regula- <br />tory agencies which are not in conflict therewith. <br />The operator shall provide at least one access chan- <br />nel for each of the following activities: <br /> <br />(a) public access; <br /> <br />(b) educational access; <br /> <br />(c) government access; <br /> <br />(d) leased access; <br /> <br />as each of these channels is defined under FCC <br />regulations. Under the test of utilization as <br />prescribed by FCC rules, the operator shall make <br />available additional educational access channels <br />of each type for local use activated on a <br />schedule as provided in the applicable FCC rules. <br /> <br />11. Construction Provisions - Use of Streets and Pole Attachments. <br /> <br />11.1 <br /> <br />Construction Schedule: The franchise shall be <br />diligent in attaining a Certificate of Compliance <br />from the FCC. The franchisee shall provide the <br />County with copies of all filings with the FCC <br /> <br /> <br />
