The Board of Commissioners <br />shall order the franchisee to comply with this section <br />in case of specific violations, which it may investi- <br />gate upon complaint or on its own motion. <br /> <br />Provisions Governing the Term, Renewal, Renegotiation, and Transfer <br />of a Franchise. <br /> = ~ Term. The franchise and rights therein granted s~hall <br /> take effect and be in force for a period of fifteen <br /> years from and after the grant and acceptance date of <br /> the f~aochise which shall be effected by the execution <br /> of the franchise agreement which shall occur not more <br /> than thirty (30) days from the adoption of a resol- <br /> ution by the Board of Commissioners designating the <br /> franchisee, unless such time is extended by the Board <br /> of Commissioners. <br /> <br />5.2 <br /> <br />5.3 <br /> <br />Termination of Franchise: Upon termination of the <br />franchise for whatever reason, including expiration <br />or revocation, the County shall have the right to <br />determine whether the franchisee shall be eligible to <br />continue to operate and maintain the CATV system. <br /> <br />~xPiration of Franchise: Upon the expiration the <br />term of the franchise and subje£t to approval by the <br />Board of Commissioners, the franchisee may negotiate <br />renewal of its franchise for an additional period not <br />inconsistent with FCC rules and regulations. <br /> <br />The franchisee shall notify the County in writing no <br />less than one (1) year in advance of the expiration <br />date of its desire to renew or not to renew the fran- <br />chise. The County may propose certain franchise mod- <br />ifications to the franchisee and mak~ any given re- <br />newal contingent upon acceptance of such modifications <br />Renewal shall be preceded by a public hearing held at <br />least thirty (30) days in advance of decision by the <br />Board of Commissioners. A renewal may be granted not <br />more than two (2) years prior to the expiration of any <br />existing term, The Board of Commissioners may deter- <br />mine whether or not the franchisee has performed sat- <br />isfactorily its obligations under the franchise by <br />reviewing the following~ <br /> <br />(a) Technical developments and performance of the <br /> system; <br /> <br />(b) Programming; <br /> <br />(c) Other services offered; <br /> <br />(d) Cost of service; <br /> <br />(e) Compliance with any requirement in the ordinance <br /> or in FCC regulations; <br /> <br />(f) Annual and other reports made to the County or <br /> the FCC; <br /> <br />(g) Extension of service; and <br /> <br />~[h) Other matters of concern, <br /> <br />In the event the current franchisee is determined by <br />the Board of Commissioners to have performed unsat- <br />isfactorily, new applicants shall be sought and eval- <br />uated by the County Manager and Board of Commissioners <br />and a franchise award may be made according to appli- <br />cation and award procedures se~ forth herein. <br /> <br />Upon failure to renew the franchise following expir- <br />ation of the term of the franchise, the County shall <br />]~ave the right of first refusal to p~r. chase the CATV <br /> <br /> <br />
