270 <br /> <br /> The Board of Commissioners for the County of Cabarrus, North Carolina, <br />met in regular session at the Courthouse in. Concord, North Carolina, the <br />regular place of meeting, on Thursday, November 9, 1978, at 9:30 A.M. <br /> Present - Chairman: S. Glenn Hawfield, Jr. <br /> Commissioners: Robert A. McClary <br /> John A. Hammett <br /> Marcelle Milloway <br /> Troy R. Cook <br /> The invocation was given by Reverend Leonard H. Bolick of the Calvary <br />Lutheran Church. <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Hammett <br />and unanimously carried, the minutes of October 5, 16, and 26, 1978, were <br />approved. <br /> UPON MOTION of Commissioner McClary, seconded by Commissioner Hammett <br />and unanimously carried, the Board moved to accept the audit report for <br />the County fiscal year 1977-78 as presented by Mr. Gill Johnson of the <br />accounting firm Sherill & Smith with possible questions concerning the <br />report to be answered at future Commissioners' meetings. <br /> UPON MOTION of Commissioner McClary, seconded by Commissioner Hammett <br />and unanimously carried, the Board approved the following amendments to <br />the Cabarrus County Cable Television Ordinance: <br /> <br /> 3.10 "Franchise Area" shall mean all of Cabarrus County outside of the <br />corporate limits of any city, provided, no service shall be required to <br />be delivered to subscribers who reside in areas not having at least 50 <br />residential units per cable mile for the first year of this franchise and <br />thereafter service shall be provided in all areas where the density of <br />residential units is equivalent to or greater than 45 residential units <br />per cable mile subject to the schedule set out in Paragraph 6.2. <br /> 6.2 Service: The franchisee agrees to make available basic CATV ser- <br />vice to all residents of the County within the basic service area, subject <br />to the provisions of Section 6.4. The franchisee shall provide service to <br />all subscribers who reside in areas not having less than 50 residential <br />units per cable mile within the first year after receiving certification <br />and permission from the FCC to begin construction. Thereafter, franchisee <br />shall provide service in all areas where the density of residential units <br />is equal to or greater than 45 residential units per cable mile, provided <br />that the percentage of the franchise area to be served where there are 45 <br />residential units per cable mile shall not be less than: <br /> (a) 50% at the end of 2 years. <br /> (b) 70% at the end of 3 years. <br /> (c) 80% at the end of 4 years. <br /> (d) 90% at the end of 5 years. <br /> 6.4 Basic Service Area: The franchisee shall provide its service to <br />residents of the County in areas where the density of dwelling units is <br />equivalent to or greater than 45 residential units per cable mile. Pro- <br />vided that within one year after the certificate of approval is obtained <br />from the FCC service shall be required only for residents of the County <br />in areas where the density of the dwelling units is equivalent to at least <br />50 residential units per cable mile, provided that said franchisee shall <br />adhere to the schedule set out in Paragraph 6.2. The franchisee shall ex- <br />tend its service to such areas and only the standard installation charge <br />specified in the rate resolution will apply to such areas. Special in- <br />stallation charges may be made where the rate of residential units per <br />mile is less than the equivalent of 45 residential units per mile; pro- <br />vided, however, that such special charges shall not exceed the direct <br />cost to the franchisee of such installation. Decisions over provision <br />and extension of service by the franchisee as well as charges may be ap- <br />pealed to the County Manager. <br /> 12.14(f) A complete financial audit statement including a statement <br /> of income to be certified by a public accountant to be sub- <br /> mitted no later than ninety (90) days after the end of the <br /> preceding fiscal year of the franchisee. <br /> <br /> UPON MOTION of Commissioner Hammett, seconded by Commissioner McClary <br />and unanimously carried, the Board approved the ~ollowing amendment to the <br />Cabarrus County Cable Television Ordinance: <br /> <br /> <br />
