407 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in adjourned <br />regular session at the Courthouse in Concord, North Carolina on May 20, <br />1980 at 7:30 P.M. <br /> Present - Chairman: Troy Ro Cook <br /> Commissioners: Ralph C. Bonds <br /> Marcelle Milloway <br /> James W. Lentz <br /> J. Ray Allen <br /> UPON MOTION of Commissioner Milloway, seconded by Commissioner Bonds and <br />unanimously carried, the Board approved the discharge of fireworks under the <br />supervision of K & K International, Inc., at the Charlotte Motor Speedway <br />on Sunday, May 25, 1980. <br /> UPON MOTION of Commissioner Milloway, seconded by Commissioner Lentz <br />and unanimously carried, ~e Board approved the sale of four surplus Rex <br />Compactor Wheels to the highest bidder, Road Machinery Services, Inc., in <br />the amount of $1,000.00. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Allen and <br />unanimously carried, the Board approved the following agreement between <br />Palmer Mountain Farms, Inc., and Cabarrus County. <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br /> THIS AGREEMENT, made and entered into this 15th day of May, 1980, by <br />and between PALMER MOUNTAIN FARMS, INC., hereinafter referred to as <br />"CONTRACTOR", and CABARRUS COUNTY, hereinafter referred to as "COUNTY"; <br /> <br />W I T N E S S E T H : - <br /> <br /> That whereas, County is the lessee from the State of North Carolina <br />of a portion of the Jackson Training School land; and whereas, Contractor <br />has removed certain dirt from said land and has refilled said land with <br />unsuitable dirt, rocks and other materials; and whereas, the parties have <br />agreed that the Contractor will restore the land in a manner and method <br />outlined by Gardner Gidley & Associates and acceptable to the Board of <br />Commissioners of Cabarrus County. <br /> <br /> NOW, THEREFORE, in consideration of the premises and the agreements <br />hereinafter made, the parties do agree as follows: <br /> <br /> 1. Contractor will do the following work on the site to restore <br />the land leased by the County on which it did grading and filling. <br /> <br /> A. It will have a topographical survey of existing conditions <br />prepared at a scale of 1" TM 50' with 2' contour intervals. <br /> <br /> B. Using this map, it will have Gardner Gidley & Associates <br />prepare a grading plan along with the revised site plan for the affected <br />area. <br /> <br /> C. Using this plan, Contractor will then remove all undesirable <br />soil and other material it has used to fill and will fill in those areas <br />and all areas where excess cut has been taken as detailed by Gardner Gidley <br />& Associates, with material of acceptable quality so that the fill material <br />can be compacted to 95% Standard Proctor, ASTM-D-698. Compaction tests <br />shall be performed at Contractor's expense to insure that this degree of <br />compaction has been obtained. Contractor shall then cover the area with <br />4" to 6" topsoil approved by Gardner Gidley & Associates and seed and <br />fertilize said area in a manner satisfactory with Gardner Gidley & Associates. <br /> <br /> 2. Upon satisfactory completion of the work provided herein by the <br /> Contractor in a manner approved by Gardner Gidley & Associates and the Board of <br /> County Commissioners, the Board will release the Contractor from any and all <br /> liability to Cabarrus County. <br /> <br /> IN TESTIMONY WHEREOF, the parties have caused this instrument to be <br /> executed by authority duly given, the day and year first above written. <br /> <br /> <br />
