455 <br /> <br />has been removed, the employment, promotion, transfer, or salary <br />adjustment of any individual to whom it has been wrongfully denied, <br />or other· suitable action to correct the abuse which may include <br />requirement of payment for any loss of salary which has resulted <br />from the improper discriminatory action of the appointing authority. <br /> <br />The decision of the State Personnel Commission shall be binding in <br />appeals of competitive service employees if the Commission finds <br />that the employee has been subject to discrimination or in any case <br />where a binding decision is required by applicable federal standards. <br />However, in all other local employee appeals, the decision of the <br />State Personnel Commission shall be advisory to the local department <br />head. <br /> <br />Section 6. Back Pay Awards <br />Back pay and benefits may be awarded to reinstated employees winning <br />appeals in suspension, demotion, dismissal, and discrimination cases. <br /> <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Bonds and <br />unanimously carried, the Board declared the old County building on Church <br />Street and all of its contents and materials as surplus property and authorized <br />the County Manager to sell any of the contents and materials that can be <br />salvaged from the building at public auction. <br /> UPON MOTION of Commissioner Allen, seconded by Commissioner Milloway and <br />unanimously carried, the Board designated by resolution Mr. Benny H. Mabrey, <br />Sr., as Emergency Management Director for Cabarrus County. <br /> UPON MOTION of Commissioner Bonds, seconded by Commissioner Lentz and <br />unanimously carried, the Board authorized Mr. John Boger, County Attorney, <br />to begin prgceedings for the purchase of the old Stop and Shop Building on <br />Church Street by the County for the sum of $80,000.00 with the money to be <br />appropriated from Commissioners' Contingency Fund. <br /> The Board reviewed the Report of Geotechnical Exploration at Stonewall <br />Jackson Park'by Law Engineering Testing Company. According to the company's <br />findings', the "existing man-made fill will not provide reliable support for <br />the proposed tennis courts and paved parking." The report indicated that some <br />of the areas tested at the site were improperly filled and included recommendations <br />for preparing the site in order to provide good subgrade support for the proposed <br />construction. The Board directed that a copy of the report be presented to <br />Mr. Robin Hayes of Palmer Mountain Farms, Inc., for the work as recommended by <br />Law Engineering Testing Company to be performed by Mr. Hayes to fulfill the terms <br />of the contract of May 15, 1980. The Board also directed that a copy of the <br />soil analysis report and seeding requirement be forwarded to Mr. Hayes. <br /> UPON MOTION of Commissioner Milloway, seconded by Commissioner Bonds and <br /> unanimously carried., the Board moved to go into Executive Session to discuss a <br /> personnel matter. <br /> UPON MOTION of Commissioner Milloway, seconded by Commissioner Lentz and <br /> unanimously carried, the Board moved to terminate the Executive Session. <br /> Chairman Cook stated that the Board had taken no action regarding the <br /> personnel matter in Executive Session. <br /> There being no further business to come before the Board, the meeting was <br /> adjourned. <br /> <br />Clerk to the Board <br /> <br /> <br />
