If the Commission controls more than one <br />park, a calculation shall be made based on the population Within <br />a 10-mile radius of each such park. The separate calculations <br />shall be aggregated to arrive at each Participating Unit's pro- <br />portionate share of the Commission's annual budget. <br />Ownership and Disposition of Real Property <br />A. Title to Real Property <br /> Title to all real property presently owned by the <br /> Participating Units will remain with the Participating Units. <br /> Real property acquired by any Participating Unit will there- <br /> after remain the property of the acquiring Participating Units. <br /> Real property acquired by the Commission in any manner shall <br /> be acquired by it solely as agent for the Participating Units, <br /> who shall hold title to such real property as tenants in common. <br />B. pisposition of Real Property <br /> Disposition of real property owned by the Commission will <br /> be disposed as agreed by the Participating Units consistent <br /> with all legal requirements. For purposes of disposition, <br /> property owned by the Commission shall be deemed to be held <br /> by the Participating Units as tenants in common in shares equal <br /> to their pro rata appropriations or in-kind contributions to <br /> the Commission from the Commission's inception to the time of <br /> disposition, or for the ten years prior to disposition, which- <br /> ever period is shorter. If the Participating Units fail to <br /> agree on the manner of disposition of the property, each <br /> Participating Unit will name one citizen not a resident of any <br /> Participating Unit to a binding arbitration committee and <br /> those members of the committee will request the North Carolina <br /> Association of County Commissioners to select one citizen who <br /> shall not be a resident of any Participating Unit. The <br /> ~ommittee shall determine the manner of disposition of the real <br /> property consistent with all legal requirements. <br /> Duration, Amendments and Modifications <br /> This Agreement shall be effective until amended or terminated <br /> according to its terms. This agreement may be modified, amended <br /> or terminated at any time through the unanimous action by the <br /> Participating Units. <br /> Addition or Withdrawal of Governmental Units <br /> Any additional county or city may be included in the Cabarrus- <br /> Rowan Park Commission and become a party to this agreement by adopting <br /> and executing this agreement and with the unanimous approval of the <br /> Participating Units then party to this Agreement.
