479 o o o equal to the ratio that its total population bears to the total population within a 10-mile radius of each park under the control of the Commission. If the Commission controls more than one park, a calculation shall be made based on the population Within a 10-mile radius of each such park. The separate calculations shall be aggregated to arrive at each Participating Unit's pro- portionate share of the Commission's annual budget. Ownership and Disposition of Real Property A. Title to Real Property Title to all real property presently owned by the Participating Units will remain with the Participating Units. Real property acquired by any Participating Unit will there- after remain the property of the acquiring Participating Units. Real property acquired by the Commission in any manner shall be acquired by it solely as agent for the Participating Units, who shall hold title to such real property as tenants in common. B. pisposition of Real Property Disposition of real property owned by the Commission will be disposed as agreed by the Participating Units consistent with all legal requirements. For purposes of disposition, property owned by the Commission shall be deemed to be held by the Participating Units as tenants in common in shares equal to their pro rata appropriations or in-kind contributions to the Commission from the Commission's inception to the time of disposition, or for the ten years prior to disposition, which- ever period is shorter. If the Participating Units fail to agree on the manner of disposition of the property, each Participating Unit will name one citizen not a resident of any Participating Unit to a binding arbitration committee and those members of the committee will request the North Carolina Association of County Commissioners to select one citizen who shall not be a resident of any Participating Unit. The ~ommittee shall determine the manner of disposition of the real property consistent with all legal requirements. Duration, Amendments and Modifications This Agreement shall be effective until amended or terminated according to its terms. This agreement may be modified, amended or terminated at any time through the unanimous action by the Participating Units. Addition or Withdrawal of Governmental Units Any additional county or city may be included in the Cabarrus- Rowan Park Commission and become a party to this agreement by adopting and executing this agreement and with the unanimous approval of the Participating Units then party to this Agreement. Such additional governmental units shall be governed by the terms of this Agreement. Any Participating Unit may terminate its participation in this agreement and withdraw from the Commission by giving one year's written notice to all other Participating Units of intent to withdraw from the Commission, which withdrawal may only be effective as of the June 30th next occurring at or after the expiration of the one year notice period~ Effective Date This agreement shall become effective when duly approved and executed by and on behalf of Cabarrus and Rowan Counties. IN WITNESS THEREOF, that the Participating Units whose endorse- ment appears hereafter have approved and caused this instrument to be executed by their respective chairmen and attested by their respective clerks.
