493 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session at the Courthouse in Concord, North Carolina on Monday, March 16, <br />1981, at 7:00 P.M. <br /> Present - Chairman: Ralph C. Bonds <br /> Commissioners: J. Harold Nash <br /> Troy R. Cook <br /> James W. Lentz <br /> Kenneth F. Payne <br /> The invocation was given by Reverend Thurmond C. Plexico of St. James <br />Lutheran Church. <br />UPON MOTION of Commissioner Nash, seconded by Commissioner Lentz and <br />unanimously carried, the minutes of March 2, 1981 were approved as written. <br /> UPON MOTION of Commissioner Lentz, seconded by Commissioner Payne and <br />unanimously carried, the Board approved the request for the transfer of <br />franchise refuse collection area from J & F Disposal Company to Ray Helms <br />Garbage Service. This franchise area covers the area from the City of <br />Concord down Highway 601 to Union County line, East to Stanly County line, <br />1-85 North to Lane Street, Lane Street to Old Salisbury Road, and Old <br />Salisbury Road to Rowan County line. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Cook with <br /> Commissioners Payne, Cook, and Nash voting for and Chairman Bonds and <br /> Commissioner Lentz voting against, the Board approved the acquisition <br /> of equipment for the Planning Department-Land Records Section at a cost <br /> of $7,500.00 for the purchase of a portion of the equipment and $600.00 <br /> per month for the lease and maintenance of a printer and plotter for the <br /> remainder of this budget year. <br /> The amended motion made by Chairman Bonds to table the acquisition <br /> of the equipment until July 1, 1981 with the purchase of the eauipment <br /> included in the 1981-82 budget failed for lack of second. <br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Payne with <br /> Commissioners Cook, Payne, and Nash and Chairman Bonds voting for and <br /> Commissioner Lentz voting against, the Board appropriated $600.00 from the <br /> Commissioners' Contingency Fund to Planning Department-Land Records Section <br /> for the lease cost and maintenance of a plotter and printer for the remainder <br /> of the budget year. <br /> UPON MOTION of Commissioner Nash, seconded by Chairman Bonds and <br /> unanimously carried, the Board adopted the following resolution. <br /> <br />It is HEREBY RESOLVED by the BOARD OF COM~ISSIONERS OF CABARRUS COUNTY, <br />NORTH CAROLINA, in a meeting held at 7:00 o'clock P.M., March 16, 1981, that: <br /> 1. The person serving presently or in the future in the capacity <br /> of Director of Social Services for Cabarrus county is hereby <br /> empowered with an assigned all the authority and duties, pertaining <br /> to Aid to the Needy Blind, as are conferrable upon the said Director <br /> under North Carolina General Statute 111-35 which is as follows: <br /> §111-35. "Authority of director of social services.--The respective <br /> boards of county commissioners of each county are hereby authorized <br /> to empower and confer upon the county director of social services <br /> for their respective counties the authority to perform any or all <br /> acts or functions which the previous sections of this Article <br /> direct or authorize the county board of commissioners to perform. <br /> Any act or function performed by a county director of social <br /> services under the authority of this section shall be reported by <br /> him~to the respective county board of commissioners for its review, <br /> and for alternative action or disposition where deemed appropriate <br /> by such board. Provided that the respective boards of county <br /> commissioners shall make no alternative or different disposition bf <br /> a matter which the county director of social services is empowered <br /> to act upon which would prejudicially affect the status of any <br /> aid to the blind recipient without first affording such recipient <br /> reasonable notice and opportunity to be heard. (1971,c. 348,s.1.)" <br /> 2. The authority and duties herein conferred and assigned are con- <br /> ferred upon and assigned to any person who is lawfully acting as <br /> the Director when the functions of the Director are not being <br /> performed by a person officially designated and holding the position <br /> of Director of Social Services. <br /> <br /> UPON MOTION of Commissioner Cook, seconded by Chairman Bonds with <br />Commissioners Cook, Lentz, and Payne and Chairman Bonds voting for and <br />Commissioner Nash voting against, the Board adopted the following Flood <br />Damage Prevention Ordinance. <br /> <br /> <br />
