524 <br /> <br /> Mr. John Boger, County Attorney, requested that the proposed amend- <br />ment to the Animal Control Ordinance be amended to read as follows: <br /> <br />The owner may reclaim his impounded dog when he complies with <br />the County License Tax Ordinance and pays a fee of Twenty <br />Dollars ($20.00) per dog plus One Dollar ($1.00) for each day <br />the dog is kept. <br /> <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Payne <br />with Commissioners Nash, Payne, and Lentz and Chairman Bonds voting for <br />and Commissioner Cook voting against, the Board moved to accept the <br />changes to the proposed amendment to the Animal Control Ordinance as sub- <br />mitted by the County Attorney. <br /> UPON MOTION of Commissioner Payne, seconded by Chairman Bonds with <br />Commissioners Payne, Nash, and Lentz and Chairman Bonds voting for and <br />Commissioner Cook voting against, the Board passed on first reading the <br />following amendment to the Animal Control Ordinance of Cabarrus County. <br /> <br />BE IT ORDAINED BY THE COUNTY COMMISSIONERS OF CABARRUS COUNTY: <br /> <br /> That the Animal Control Ordinance of Cabarrus County enacted on the <br />8th day of January, 1976, is hereby amended to add the following: <br /> <br /> Section 1. MUZZLES REQUIRED: <br /> The owner of every fierce, dangerous or vicious dog shall confine <br />the dog within a building or secure enclosure and not take it out of the <br />building or secure enclosure unless it is securely muzzled. <br /> <br /> Section 2. IMPOUNDMENT: <br /> (a) Unlicensed dogs, dogs found running at large and dogs in violation <br />of Section 1 shall be taken up by the Dog Warden and impounded in the <br />shelter or pound as designated by the Commissioners. <br /> (b) When a dog is found running at large and its ownership is known <br />to the Dog Warden, it need not be impounded, but the agent may, at his <br />discretion, cite its owner to appear in court to answer to charges of <br />violating this ordinance. <br /> (c) As soon as he impounds a licensed dog or any other dog whose <br />owner is known to the Dog Warden, the Dog Warden shall notify its owner, <br />informing him that his dog has been impounded and how he may regain <br />custody of the. dog. <br /> (d) Impounded dogs shall be conf~¢din a humane manner for not less <br />than three (3) days and if not claimed or adopted by new owners, may there- <br />after be disposed of in a humane way under the direct supervision of the <br />Animal Warden. <br /> (e) The Animal Warden may transfer any animal held at the animal <br />shelter or pound to the Cabarrus Animal Protection Association or other <br />organization or person interested in providing a home for the animal after <br />the legal detention period has expired if the animal has not been claimed <br />by its owner. <br /> <br /> Section 3. REDEMPTION OF IMPOUNDED ANIMALS: <br /> (a) The owner may reclaim his impounded dog when he complies with <br />the County License Tax Ordinance and pays a fee of Twenty Dollars ($20.00) <br />per dog plus One Dollar ($1.00) for each day the dog is kept. <br /> (b) The owner of an animal impounded and not redeemed within the <br />required holding period shall be responsible for the fees incurred, whether <br />or not the animal is claimed. <br /> <br /> Section 4. RECORDS. <br />(a) The Dog Warden shall keep or cause to be kept records of the <br />impoundment and disposition of all animals that come into his custody. <br /> (b) The Dog Warden shall keep or cause to be kept records of all bite <br />cases reported to him and his investigation of these bites. <br /> (c) The Dog Warden shall keep or cause to be kept records of all <br />money collected by him under Section 3. These records shall be audited by <br />the County of Cabarrus annually in the same manner as other County records <br />are audited. <br /> <br /> Section 5. PENALTY: <br /> Any person who violates any provision of this ordinance shall be <br />deemed guilty of a misdemeanor and punished by a fine not exceeding Fifty <br />Dollars ($50.00) or imprisonment for a period of not more than thirty (30) <br />days. If the violation is continued, each day's violation shall be a <br />separate offense. <br /> <br /> <br />
