<br /> The Board of Commissioners. for the County of Cabarrus met in regular
<br />session at the County Courthouse in Concord, North Carolina, on Tuesday,
<br />October 20, 1981, at 7:00 P.M.
<br /> Present - Chairman: Ralph C. Bonds
<br /> Commissioners: J. Harold Nash
<br /> Troy R. Cook
<br /> James W. Lentz
<br /> Kenneth F. Payne
<br /> The invocation was given by Reverend William W. Britt, Sr., of the
<br />Concord Church of God.
<br /> Mr. John R. Boger, Jr., County Attorney, reported that he had determined
<br />that the County's liability insurance would, cover provisions of the proposed
<br />Mutual Aid Agreement between Cabarrus County and Stanly County presented to
<br />the Board on October 5, 1981. He stated, however, there was still some
<br />question as to whether the County's workmen's compensation and collision
<br />insurance would apply to the provisions of the proposed agreement. He advised
<br />the Board to delay action on the proposed agreement until all questions
<br />pertaining to the insurance coverage were cleared up by Aetna Insurance
<br />Company.
<br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Payne and
<br />unanimously carried, the Board moved that the portion of the minutes of
<br />October 5, 1981, pertaining to the proposed Mutual Aid Agreement between
<br />Cabarrus County and Stanly County be deleted and that the remaining portion
<br />of the minutes of October 5, 1981, be approved as written.
<br /> UPON MOTION of Commissioner Cook, seconded by Commissioner Payne and
<br />unanimously carried, the Board accepted the following contract between
<br />Cabarrus County and Concord Engineering & Surveying, Inc., for engineering
<br />work in connection with the Sidestown/Shankletown Community Development
<br />Grant and authorized the Chairman to sign the contract as soon as the
<br />letter of credit to be issued by the Department of Housing and Urban
<br />Development (HUD) is in hand by the County.

<br /> CONTRACT BETWEEN
<br />THE BOARD OF COUNTY COMMISSIONERS OF CABARRUS COUNTY, NORTH CAROLINA
<br /> AND
<br /> CONCORD ENGINEERING AND SURVEYING, INC., CONCORD, NORTH CAROLINA
<br />
<br />This contract, made and entered into this day of , 1981, by
<br />and between the Board of County Commissioners of Cabarrus County, North
<br />Carolina, hereinafter called and referred to as the OWNER, and Concord
<br />Engineering and Surveying, Inc., Concord, North Carolina, hereinafter
<br />called and referred to as the ENGINEERS.

<br />WITNESSETH:
<br />
<br />WHEREAS, the OWNER has been granted funding under the Housing and Community
<br />Development Act of 1979 and as amended in 1978 by the U. S. Department of
<br />Housing and Urban Development, for the provision of a wastewater collection
<br />system in the Sidestown/Shankletown communities.
<br />
<br />NOW, THEREFORE, for and in consideration of certain money amounts herein-
<br />after specified to be paid to the ENGINEERS by the OWNER, the ENGINEERS
<br />agree to do, at their own cost and expense, all of the engineering work
<br />required to facilitate the design and construction of the said collection
<br />system.
<br />
<br />ARTICLE 1 ENGINEERING SERVICES (Engineers will perform these Services)
<br />
<br />A. The ENGINEERS agree to survey and tie down all property lines for
<br />right-of-way of outfalls (any line located outside of dedicated rights-of-
<br />way) and service connections. Locate all existing utilities.
<br />
<br />B. Coordinate the project with local, state, and federal agencies and
<br />prepare the required documents to secure approval from the agencies.
<br />
<br />C. Prepare complete construction plans and specifications. Furnish ten
<br />(10) sets of same.
