489 <br /> <br /> Mr. Jerry Schletzbaum, architect, presented recommended negotiated <br />price deductions from the total base bid of $504,338.00 for the renovations <br />to the Cabarrus County Courthouse Annex. He advised the Board that the <br />45-day period for the acceptance of the bids would expire February 12, <br />1984; however, he stated he would attempt to obtain a 15-day extension on <br />the low bids. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Milloway <br />and unanimously carried, the Board moved to table consideration of the <br />bids for the renovations of the Courthouse Annex building and not be concerned <br />about the bids received because the County cannot afford them. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Milloway <br />and Unanimously carried, the Board authorized the execution of the <br />following Management Agreement between Cabarrus County and the Cabarrus- <br />Rowan Park Commission. <br /> <br />Management Agreement between the Cabarrus-Rowan Park Commission and <br />the Cabarrus County Local Government <br /> <br />WITNESSETH <br /> <br /> WHEREAS, The Cabarrus-Rowan Park Commission, herein referred to as <br />"the Commission", desires to provide park facilities and recreation <br />services in the Northern Cabarrus and Southern Rowan area of Cabarrus <br />and Rowan Counties, and <br /> <br /> WHEREAS, the local government of Cabarrus County, herein referred <br />to as "the County", is willing to provide management services to the <br />degree as outlined in this agreement, <br /> <br />Now therefore, the two entities agree to the following: <br /> <br />The Commission agrees to: <br /> <br />Designate the County Manager as the Commission's Purchasing <br />Agent for all purchases by the Park Commission. <br /> <br />o <br /> <br />By February 1 of each year, prepare and submit an operations, <br />maintenance, and capital construction budget to the respective <br />recreation commissions of all participating units. <br /> <br />Follow in strict accordance all North Carolina State Statutes <br />that relate to the bidding of supplies, the awarding of <br />construction projects, and other duties the Board is empowered <br />to perform. <br /> <br />Save harmless and indemnify the County against all claims, losses, <br />damages, injuries, causes of action, lawsuits, expenses, and <br />liability arising from or arising out of the Commission's <br />failure to comply with the responsibilities and stipulations <br />found herein and other responsibilities as outlined in the <br />"Resolution creating the Joint Park Commission", wherever such <br />claims, losses, damages, injuries, causes of action, lawsuits, <br />expenses and liabilities arise from the negligent or willful acts <br />or omissions of~the Commission. <br /> <br />The County agrees: <br /> <br />To provide accounting and other fiscal control in compliance with <br />accounting procedures stipulated in North Carolina General <br />Statutes 159. <br /> <br />To invoice all participating units of the Commission on a <br />monthly basis based on the participating unit's proportionate <br />share of the financial obligation of the Commission for the <br />previous month. <br /> <br />o <br /> <br />To provide monthly financial reports on all the Commission's <br />expenditures and revenue receipts for the previous month and a <br />summary of the year-to-date expenditures and revenue collections <br />of the Commission. <br /> <br /> <br />
