506 <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board approved the zoning amendment to permit <br />Multi-Family Dwellings and Single-Family Detached site built homes in <br />the C-i, C-2, C-3, and C-4 zones as stated above. <br /> <br />(3) DELETE: <br /> <br />5.23 Fencing Around Swimming Pools: <br />Swimming pools are allowed as a matter of right as an <br />accessory use to a residence provided that said residential <br />swimming pool is completely isolated from adjacent properties <br />and streets by a fence or wall at least four and one-half <br />(4½) feet in height. The fence or wall may be constructed <br />of wood, masonry or similar materials or by a chainlink or <br />similar fencing with natural screening (Section 5.10), <br />provided that it complies with the requirements of the <br />location of accessory buildings in the district in which <br />it is located. <br /> <br />ADD: <br /> <br />5.23 Fencing Around Swimming Pools: <br />Swimming pools are allowed as a matter of right as an <br />accessory use to a residence provided that said residential <br />swimming pool is completely isolated from adjacent properties <br />and streets by a semi-open or a closed fence or wall of at <br />least four and one-half feet (4½) in height. Fences <br />surrounding swimming pools shall be designed so as to <br />minimize the possibility of unauthorized or unwary persons <br />from entering the pool area. In the case of a semi-open <br />(such as chainlink) fence, the open space between each <br />section of fencing material shall be no larger than sixteen <br />(16) square inches. The fence or wall may be constructed <br />of wood, masonry or similar materials or by a chainlink or <br />similar fencing with natural screening (Section 5.10), provided <br />that it complies with the requirements of the location of <br />accessory buildings in the district in which it is located. <br /> <br />Planning Board approved this request. <br /> <br /> Ms. Peggy Hice questioned the need for the required fencing if <br />a person lived in a rural area and there were no small children living <br />near the swimming pool. Ms. Hice was advised that the zoning text amendment <br />would be uniform throughout the county. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner <br />Payne and unanimously carried, the Board approved the zoning text <br />amendment pertaining to fencing around swimming pools as stated above. <br /> <br />(4) Amend the following to read Page 23, Section 3.2-4: <br /> <br />ARR <br /> <br />(A) Minimum lot frontage shall be fifty (50) feet. <br />(B) Where residence(s) will be serviced by public or community <br /> water or sewer facilities, the lot area need only be <br /> thirty thousand (30,000) square feet. In such cases <br /> the other dimensional requirements will comply with that <br /> of the R-30 district. <br />(C) Where residence(s) will be serviced by public or community <br /> water and sewer facilities, the lot area need only be <br /> twenty thousand (20,000) square feet. In such cases <br /> the other dimensional requirements will comply with that <br /> of the R-30 district. <br /> <br />R-40 (A) <br /> <br />(B) <br /> <br />(c) <br /> <br />Sixty thousand (60,000) square feet required for each two- <br />family dwelling (corner lots only). Permitted in subdivisions, <br />otherwise conditional. <br />There shall be a fifteen (15%) percent lee-way on the <br />minimum lot size for structures located in cul-de-sacs. <br />Where residence(s) will be serviced by public or community <br />water or sewer facilities, the lot area need only be <br />thirty thousand (30,000) square feet.
