542 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session at the County Courthouse in Concord, North Carolina, on Monday, <br />April 16, 1984, at 7:00 P.M. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Archie Y. Barnhardt <br /> Marcelle Milloway <br /> J. Harold Nash <br /> Kenneth F. Payne <br /> The invocation was given by Reverend Michael Tolbert of Westford <br />United Methodist Church. <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Barnhardt <br />and unanimously carried, the minutes of April 2, 1984, were approved as <br />written. <br /> The Board reviewed the proposed resolution to allow the Piedmont Area <br />Mental Health, Mental Retardation and Substance Abuse Authority to own <br />property under the provisions of G. S. 122-35.53(c). The available options <br />as outlined in a letter from Dr. Robert C. Lorish, Area Director, for <br />the ownership of property were as follows. <br /> <br />1) County ownership <br />2) Area Authority ownership - no County Commissioner review <br />3) Area Authority ownership with prior approval by County <br /> Commissioners <br /> <br /> UPON MOTION of Commissioner Nash, seconded by Commissioner Payne <br />and unanimously carried, the Board adopted the following resolution to <br />allow the Piedmont Area Mental Health, Mental Retardation and Substance <br />Abuse Authority to own property with prior approval by the Board of <br />County Commissioners. <br /> <br />RESOLUTION GRANTING CONSENT FOR PIEDMONT AREA <br />MENTAL HEALTH, MENTAL RETARDATION, AND SUBSTANCE <br /> ABUSE AUTHORITY TO HOLD TITLE TO <br /> REAL PROPERTY AND TO ACQUIRE THE SAME <br /> <br /> WHEREAS the North Carolina General Assembly has amended G.S. <br />122-35.53 (c) to grant area mental health, mental retardation and <br />substance abuse authorities authority to hold title to real property <br />and the authority to acquire the same upon the consent of all boards <br />of commissions of all counties which comprise the area authority; <br />and <br /> <br /> WHEREAS Piedmont Area Mental Health, Mental Retardation, and <br />Substance Abuse Authority which is comprised of the counties of <br />Cabarrus, Stanly, and Union has requested that the aforementioned <br />consent be given by the Boards of Commissioners of each affected <br />county, and <br /> <br /> WHEREAS it is in the best interest of all concerned the afore- <br />mentioned consent be given, <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners <br />of Cabarrus County hereby gives its consent pursuant to G.S. 122-35.53(c) <br />for Piedmont Area Mental Health, Mental Retardation, and Substance <br />Abuse Authority to hold title to real property and to acquire the same <br />after presentation to and approval by the Board of Commissioners of <br />Cabarrus County on each proposed real property transaction. <br /> <br />This the 16th day of April, 1984. <br /> <br />/s/ James W. Lentz <br /> <br />Chairman <br /> <br /> The proposed Ordinance Governing Surface Discharge Sewage Treatment <br />Plants in Cabarrus County was presented for the second reading. This <br />proposed Ordinance had been approved on the first reading on April 2, 1984, <br />by a four (4) to one (1) vote by the Board. <br /> Motion was made by Commissioner Milloway and seconded by Commissioner <br />Barnhardt to adopt on second reading the Ordinance Governing Surface Discharge <br />Sewage Treatment Plants in Cabarrus County, North Carolina. No vote was <br />taken on motion. <br /> <br /> <br />
