553 <br /> <br />(10) Maintenance - maintenance of the Private Road must be provided by <br /> the lot owners that are served by the road. The road maintenance <br /> agreement between the lot owners is required to insure that the <br /> cost is shared equally and a mechanism for maintenance is set up. <br /> This responsibility for maintenance is the property owners and <br /> neither the State nor Cabarrus County will maintain the road. <br /> <br />PROPERTY TRANSFERS ALONG PREVIOUSLY EXISTING PRIVATE ROADS <br /> <br /> The transfer of property along previously existing Private Roads may <br />occur subject to the following regulations: <br /> <br />(1) The tract to be transferred has at a minimum sixty (60) feet of <br /> frontage on the road. <br />(2) The road is in such condition as to provide year round access <br /> in a quality manner. A full disclosure of road status is <br /> presented to the new property owner and to the Cabarrus County <br /> Subdivision Administrator. Included in the road disclosure <br /> is a statement explaining how road maintenance will be handled, <br /> as well as a further statement which makes the buyer fully aware <br /> that the road is a Private Road and that the access may or may <br /> not be considered acceptable by Lending Institutions in the future. <br /> The disclosure statement shall be recorded with the deed. <br />(3) That a property owner may transfer property utilizing this <br /> provision only once within a two (2) year period. <br />(4) Ail other provisions of the Cabarrus County Subdivision Regulations <br /> are complied with. <br /> <br />SPECIFICATION REQUIREMENTS <br /> <br />(1) A minimum of 14 feet vertical clearance must be provided above the <br /> travelway to permit the passage of large vehicles under power lines <br /> and tree limbs. <br />(2) The property owner is responsible for obtaining the required permit <br /> for access to the state maintained road. This permit can be obtained <br /> from the North Carolina Department of Transportation in Albemarle. <br /> Permits are normally granted on request. <br />(3) Curves shall be constructed with a minimum centerline radius of 125 <br /> feet. The right-of-way must be designed with bends that will provide <br /> sufficient width to construct the road to this minimum radius. For <br /> example, a 90 degree bend in a 45 foot right-of-way must include <br /> sufficient width for the travelway and the necessary shoulders, ditches <br /> and slopes. <br /> <br />(NOTE: Drawings relating to the Private Road Standards are on file in <br /> the Planning Department located in the County Courthouse.) <br /> <br /> There being no further business to come before the Board, the meeting <br />was adjourned. <br /> <br />Clerk to the Board <br /> <br /> <br />
