13 <br /> <br /> The Board of Commissioners for the County of Cabarrus met at 7:00 P.M. <br />on Thursday, July 19, 1984, in Courtroom 2 of the County Courthouse in Concord, <br />North Carolina, for a public hearing regarding proposed Zoning Atlas Amendments. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Archie Y. Barnhardt <br /> Marcelle Milloway <br /> J. Harold Nash <br /> Kenneth F. Payne <br /> Mr. F. A. Rankin, Chairman of the Cabarrus County Planning Board, <br />presented each of the proposed amendments as recommended by the Planning <br />Board. Mr. James F. Owens, Assistant Planning Director, reviewed the <br />location of each of the areas proposed for rezoning. Public input was <br />received by the Board pertaining to the proposed amendments prior to <br />action by the Board of Commissioners. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(1) <br /> <br />Petition 84-12, Kiser-Beaver Realty, township 4, Dakota Street beside <br />Royal Oaks School. Map/PIN 5612-97-9880. Wishes to rezone from <br />R-9 to RMF-6. Planning Board approved this petition, feeling the <br />County needs better developments for residents. <br /> <br /> Mr. George L. Kiser, Jr., of Kiser-Beaver Realty explained the concept <br />of cluster developments and reviewed the advantages of locating a cluster <br />development on the property. Mr. Farrar Griggs, attorney representing Kiser- <br />Beaver Realty, also spoke in favor of the rezoning petition. <br />No one was present to speak in opposition to the requested rezoning. <br />UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board approved Petition 84-12 to rezone <br />Map/PIN 5612-97-9880 from R-9 to RMF-6 as requested by Kiser-Beaver Realty. <br /> <br />(2) <br /> <br />Petition 84-1~, Leonard Schenck, Jr. (Shank), Orphanage Road, <br />¼ mile east of Trinity Church Road. Township 4, Map/PIN 5601-78-5712. <br />Wishes to rezone from RMF-7 to ARR. Planning Board denied this <br />petition, feeling that with the access to water and sewer and the <br />unavailability of RMF zones, it would be best to leave property as is <br />presently zoned. <br /> <br /> Residents of the area speaking against the rezoning petition included <br />Mr. Arlin Hudson, Mrs. Harwell, and Ms. Teresa Hagler. They objected to the <br />location of additional mobile homes in the area. <br />There was no one present to speak in favor of the rezoning request. <br />UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board denied Petition 84-13 to rezone property <br />on Orphanage Road from RMF-7 to ARR as requested by Mr. Leonard Schenck, Jr. <br /> <br />(3) <br /> <br />Petition 84-14, Medical Center Pharmacy, South Main Street at Bethpage <br />Road. Township 4, Map/PIN 5613(11)-55-3531, 55r3356, 55-3271. Wishes <br />to rezone from C-3 to C-2. Planning Board approved this petition on <br />the grounds it was a down zoning of property to meet required setbacks. <br /> <br /> Mr. James E. Scarbrough, attorney representing Medical Center Pharmacy <br />of Kannapolis, requested the rezoning of the property to obtain desired <br />setback and side yard requirements for a professional office facility. <br /> There was no one present to speak against the rezoning petition. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner <br /> Milloway and unanimously carried, the Board approved Petition 84-14 to <br /> rezone Map/PIN 5613(11)-55-3531, 55-3356, 55-3271 from C-3 to C-2 as <br /> requested by Medical Center Pharmacy. <br /> <br />(4) <br /> <br />Petition 84-15, Bobby Morgan and Don Widenhouse, Highway 601 south <br />of Highway 24-27. Township 10, b~p/PIN 5554-18-6532, 29-3165. Wishes <br />to rezone from A-2 to C-1. The Planning Board denied this request on <br />the grounds to protect the surrounding neighbors and that there was <br />no demonstrated need for the change. <br /> <br /> Mr. James E. Scarbrough, attorney representing the petitioners, requested <br />that the property be rezoned to allow Mr. Raeford McAnulty to build an auto <br />parts store on the property to be purchased from Mr. Bobby Morgan.
