561

Campaign in September. It was understood that individuals and companies
bringing tires to the landfill for cutting would be responsible for paying
for the cutting of their tires at that time.
Mr. William E. Fisher, Owner of J & F Disposal Company, Inc.; Mr.
Hubert E. Hoglen, Jr., Owner of Royal Garbage Service; and Mr. Eric Black,
District Manager of Browning-Ferris Industries of South Atlantic, Inc., were
present to request an increase in residential service rates from $7.50 per
month to $25.00 per quarter effective January 1, 1985. They stated this
rate increase was necessary due to the user fee imposed on the refuse
haulers at the Cabarrus County Landfill beginning on October 1, 1984.
UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt
with Commissioners Payne, Barnhardt, and Milloway voting for and Commissioner
Nash and Chairman Lentz voting against, the Board denied the residential
rate increase requested by the franchised refuse haulers at this time.
Commissioner Payne stated that he would recommend to the Health Board
that an investigation be made into the possibility of bidding garbage
collection service in Cabarrus County.
The Board reviewed the request from Ms. Alice H. Hedt, Regional
Ombudsman with the Centralina Council of Governments, that the Cabarrus
County Domiciliary Home Community Advisory Committee be increased by one
member and that a new committee member be appointed to fill the position
presently held by Ms. Vickie Waddell. According to Ms. Hedt, Ms. Waddell
has not attended any of the committee meetin~ or required visits since
her appointment in January, 1984.
Commissioner Milloway nominated Mrs. Frances B. Long for appointment
to the Domiciliary Home Community Advisory Committee.
UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt
and unanimously carried, the Board closed nominations for the Domiciliary
Home Community Advisory Committee.
The Board appointed Mrs. Frances B. Long to the Domiciliary Home
Community Advisory Committee for a term ending December 21, 1985.
After discussion regarding the position held by Ms. Vickie Waddell,
the Board indicated that they wished to follow the procedures adopted by
the Board of Commissioners whereby a member of a committee would be replaced
for failure to attend at least 75 percent of committee meetings. It was
noted that Ms. Waddell was recommended for appointment by the domiciliary
home administrators and letters are to be written to the administrators
requesting that they submit another name for appointment to that position.
The Board again discussed the appointment to the Cabarrus County Planning
Board. Commissioner Nash proposed that the membership on the Planning Board
be increased from five to seven members and that the previous nominees--
Messrs. R. M. Faggart, Jr., John Coble, and Robert L. Quesenberry, Jr.--
be appointed to the Planning Board.
The Board received the letters from Mr. Alvie L. Isenhour, President
of the Cabarrus County Home Builders Association, recommending Messrs.
GeneS. Holbrooks and R. M. Faggart, Jr., for appointment to the Cabarrus
County Planning Board.
UPON MOTION of Commissioner Nash, seconded by Commissioner Payne with
Commissioners Payne and Nash and Chairman Lentz voting for and Commissioners
Barnhardt and Milloway voting against, the Board approved on first reading
the increase of the Cabarrus County Planning Board to a seven person board.
Mr. John R. Boger, Jr., County Attorne~ announced that Mr. James
Rutledge had resigned from the Cabarrus County Industrial Facilities and
Pollution Control Financing Authority effective September 1, 1984. An
appointment is to be made to this Authority at the next Board meeting.
Mr. John R. Boger, Jr., County Attorney, reported that a lawsuit had
been filed on July 27, 1984, in United States District Court by Chris Roger
Harrell against Kannapolis Police Officers R. A. Caskey and S. A. May,
former Chief of Police R. L. Ketchie, the Cabarrus County Sheriff's Department,
and Cabarrus County for an alleged incident that occurred on July 27, 1981.
According to Mr. Boger, the complainant alleged false arrest, false imprison-
ment, and intentional infliction of emotional distress by the officers.
Mr. Boger further stated that the County does not have liability coverage
to cover the lawsuit as the County had liability insurance on a claims made
basis at the time of the incident. In conclusion, he recommended that the
officers named in the lawsuit be awarded a defense by Cabarrus County.
