79 <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board amended Article IV, Section I, and <br />Article VIII of the Cabarrus County Personnel Ordinance as stated above <br />in the "Self Assessment and Transition Plan to Meet Section 504 of the <br />Revenue Sharing Act" and as contained in the Cabarrus County Ordinance <br />Book. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board tabled discussion of the Emergency <br />Management Hazard Analysis until the next meeting. <br /> B. S. Brown, Jr., representing the Kannapolis Sanitary District, pre- <br />sented the following resolution which was read: <br /> <br />RESOLUTION RELATING TO THE ANNEXATION OF <br />TERRITORY TO KANNAPOLIS SANITARY DISTRICT <br /> <br /> BE IT RESOLVED BY THE BOARD OF COMMISSIONERS FOR THE COUNTY OF <br />CABARRUS: <br /> <br /> Section 1. That the Board of Commissioners for the County of <br />Cabarrus has determined and does hereby find and declare: <br /> (a) That on October 15, 1984, a resolution was received from the <br />Sanitary District Board of the Kannapolis Sanitary District relating to <br />the annexation of territory to the Kannapolis Sanitary District. <br /> (b) That the territory described in the petition consists of the <br />property of Zeb V. Russell and wife, Martha S. Russell. <br /> (c) That the petition was signed by all property owners within the <br />area requested to be annexed. <br /> (d) That said petition requests that all necessary action required by <br />Part 2 of Article 2 of Chapter 130A of the General Statutes of North <br />Carolina for the extension of the boundaries of the Kannapolis Sanitary <br />District be taken so as to annex the territory described in the petition <br />unto the Kannapolis Sanitary District. <br /> (e) That it is for the best interest of the Kannapolis Sanitary District <br />and the territory requested to be annexed unto the Kannapolis Sanitary <br />District that said territory be included within the boundaries of the <br />Kannapolis Sanitary District and receive the services of the Sanitary District. <br /> <br /> Section 2. That the Board of Commissioners for the County of Cabarrus <br />does hereby approve the annexation of the territory described in the petition <br />unto the Kannapolis Sanitary District and does hereby recommend to the <br />North Carolina Commission for Health Services that it approve the annexation <br />of the territory unto the Kannapolis Sanitary District. <br /> <br /> Section 3. That the Clerk of the Board of Commissioners for the County <br />of Cabarrus is hereby directed to certify a copy of this resolution to the <br />Director, Division for Health Services, Department of Human Resources, State <br />of North Carolina. <br /> <br /> Thereupon, upon motion of Commissioner Milloway, seconded by Commissioner <br />Nash, the foregoing resolution entitled: "RESOLUTION RELATING TO THE <br />ANNEXATION OF TERRITORY TO KANNAPOLIS SANITARY DISTRICT" was passed by the <br />following vote: <br /> <br />Ayes: <br />Noes: <br /> <br />Chairman Lentz and Commissioners Barnhardt, Milloway, Nash, and <br />Payne <br />None <br /> <br /> The boundaries of the property belonging to Zeb V. Russell and wife, <br />Martha S. Russell, petitioned to be annexed to and included in the <br />Kannapolis Sanitary District are as follows: <br /> <br />BEGINNING at a point in the boundary line of the Kannapolis <br />Sanitary District where said boundary line intersects the <br />petitioner's southern property line, this point lying 145 <br />feet, more or less, north of the point where the sanitary <br />district boundary line intersects the northern edge of Moose <br />Road, and runs thence along the boundary line of the Kannapolis <br />Sanitary District in a northerly direction 160 feet, more or less, <br /> <br /> <br />
