Examples - digging and removal by mechanical means
for sale or trade, pit gravel, clay, peat or humus, fill dirt,
creek gravel or sediment, sand and top soil. No consideration
will be given to operations which require drilling, blasting,
or subsequent manufacturing to prepare the product for the
market.

Mr. William Alexander, attorney, spoke in support of the recommended
definition for extraction of earth products, stating in his opinion it
was obvious that extraction of earth products encompassed mining and
quarrying. He stated the proposed definition was a good definition and
would suit the farmers, contractors, and residents of Cabarrus County.
UPON MOTION of Commissioner Barnhardt, seconded by Commissioner
Upright with Commissioners Barnhardt, Upright, and Payne, and Chairman
Lentz voting for and Commissioner Hamby voting against, the Board instructed
the Planning Board to draft a definition to the effect that extraction of
earth products would mean the same as mining as defined in the State Mining
Act of 1971.
Chairman Lentz introduced discussion of the establishment of a time
period for the withdrawal of zoning petitions. Mr. James F. Owens, Assistant
Planning Director, suggested the possibility of having the cut off date
for withdrawal of petitions one and one-half weeks prior to the zoning
meeting of the Board of Commissioners.
UPON MOTION of Commissioner Payne, seconded by Commissioner Hamby
and unanimously carried, the Board instructed the Planning Board to offer an
amendment concerning the time period for the withdrawal of zoning petitions.
There being no further business to come before the Board, the meeting
adjourned at 9:45 P.M.

Clerk to the Board
