178 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in the <br />Superior Courtroom of the County Courthouse in Concord, North Carolina, <br />on Thursday, March 7, 1985, at 7:00 P.M. to consider regular items of <br />business and to conduct a public hearing on proposed Zoning Atlas and <br />Text Amendments. The regular meeting had been changed from Monday, <br />Ma~ch 4, because of the Annual Legislative Conference of the National <br />Association of Counties held in Washington, D. C., on March 2 - 5, 1985. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Archie Y. Barnhardt <br /> Marcelle M. Upright <br /> Mr. Gordon L. Belo, attorney, served as legal counsel in the absence <br />of Mr. Fletcher L. Hartsell, Jr., County Attorney. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner <br />Barnhardt and unanimously carried, the Board adopted the following resolution <br />effective March 7, 1985. <br /> <br />A RESOLUTION TO ESTABLISH A CONTRACTUAL RELATIONSHIP <br /> BETWEEN THE CITY OF KANNAPOLIS, NORTH CAROLINA, <br />AND THE COUNTY OF CABARRUS CONCERNING PLANNING, <br />ZONING, BUILDING PERMITS, INSPECTIONS AND ENFORCEMENT <br /> <br /> WHEREAS, the County of Cabarrus has an operating Planning Department, <br />Zoning Office and Building Inspector's Office; and <br /> <br /> WHEREAS, the newly formed City of Kannapolis does not have the means <br />to establish such departments and employ such personnel at the present <br />time; and <br /> <br /> WHEREAS, the County of Cabarrus has indicated a willingness to <br />contract with the City of Kannapolis to provide certain needed services <br />in the area of Planning, Zoning, Building Permits, Inspections and <br />Enforcement; <br /> <br /> NOW THEREFORE, be it resolved by the City Council of the City of <br />Kannapolis, North Carolina, as follows: <br /> <br /> 1. That under the provisions of North Carolina General Statutes, <br />Section 160A-461, the City of Kannapolis does hereby contract with the <br />County of Cabarrus (subject to the approval of Board of County <br />Commissioners) whereby the personnel employed by the County of Cabarrus <br />in the Planning Department, Zoning Office and Building Inspector's <br />Office shall perform certain services for the City of Kannapolis. <br /> <br /> 2. This contract shall continue until the City of Kannapolis employs <br />personnel to perform the duties contracted for herein, or until this <br />contract is modified or terminated by the City Council of the City of <br />Kannapolis or by the Board of County Commissioners of the County of Cabarrus. <br /> <br /> 3. The City of Kannapolis shall compensate the County of Cabarrus <br />for the time, travel and any other expenses incurred by the County's <br />employees in performing services for the City of Kannapolis. Payments <br />shall be made monthly by the City, except that the initial payment shall <br />be made by the City when funds become available, but in any event, the <br />initial payment shall be made not later than August 1, 1985. <br /> <br /> 4. The Building Inspector's office of Cabarrus County shall function <br />as the Building Inspector's office for the City of Kannapolis, and shall <br />issue or withhold building permits, conduct inspections and shall be <br />clothed with all necessary authority to enforce violations of any state, <br />county or city ordinances or regulations. The same fees shall be charged <br />for City permits as are charged for County permits. These fees shall be <br />retained by the County and credited against the compensation due the <br />County under paragraph three above. <br /> <br /> 5. The Zoning Office of Cabarrus County shall function to issue <br />or withhold permits under the City's Minimum Lot Size ordinance and Mobile <br /> <br /> <br />
