244 <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Hamby <br />and unanimously carried, the Board asked that the Department of Transportation <br />evaluate Mills Circle and update its priority rating as soon as possible. <br /> Commissioner Payne stated the need for the upgrading of Poplar Tent <br />Road from a secondary road to a primary road. Mr. Patterson suggested <br />that the Board present this request at the Transportation Improvement <br />Program hearing to be held in Union County on June 6, 1985. <br /> At 10:00 A.M., Chairman Lentz stated that this was the day and hour <br />scheduled for a public hearing to determine finally whether the assistance <br />in financing the improvements for Artdale Drive would be made and asked <br />if anyone were present who wished to speak for or against these road <br />improvements under the participation paving program. <br /> A resident of Artdale Drive spoke in support of the paving 6f the <br />street. There was no one present to speak against the paving improvements <br />and the public hearing was closed. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Hamby and <br />unanimously carried, the Board adopted the following resolution authorizing <br />the participation paving program for Artdale Drive. <br /> <br /> RESOLUTION AUTHORIZING ASSISTANCE <br />IN THE FINANCING OF IMPROVEMENTS TO <br />RURAL SUBDIVISION AND RESIDENTIAL STREETS <br /> <br /> WHEREAS, The Board of Cabarrus County Commissioners on May 20, <br />1985, adopted a preliminary resolution giving notice of intention to <br />assist in the financing of improvements to rural subdivision and <br />residential streets; and <br /> <br /> WHEREAS, due notice has been given that on the 3rd day of June, <br />1985, at 10:00 A.M. in the Commissioners' Room in the Cabarrus County <br />Courthouse, held on whether the assistance in'financing the road improve- <br />ments hereinafter described shall be made and that all objections to <br />the legality of the making of such financial assistance are required <br />by law to be made in writing, signed in person or by an attorney, and <br />filed with the Clerk to the Board at or before the time of the public <br />hearing; and <br /> <br /> WHEREAS, the public hearing has now been held and any objections made <br />concerning the financial assistance were considered; <br /> <br /> NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF <br />THE COUNTY OF CABARRUS: <br /> <br /> 1. That the street or streets, road or roads, or rights of way <br />herein set out are without paving, and public interest requires that <br />asphalt paving be made available, and that abutting property will be <br />benefitted to the extent of the part of the cost thereof to be assessed <br />against such abutting property. <br /> <br /> 2. If the local improvements are ordered made by the North Carolina <br />Department of Transportation, the County of Cabarrus shall remit to the <br />North Carolina Department of Transportation the proportion of the cost <br />thereof representing the total local share as required by policies of the <br />North Carolina Department of Transportation's Secondary Road Council. <br /> <br /> 3. That the local improvements to be'made on the street or streets, <br />road or roads, or right of way, set out above are as follows: <br /> <br />ASPHALT PAVING <br /> <br />2570 Lineal Feet <br /> <br />SECONDARY ROAD NUMBER <br /> <br />SR 1563 <br /> <br />STREET OR ROAD <br /> <br />Artdale Drive <br /> <br /> 4.
