286 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in special <br />session at the County Courthouse in Concord, North Carolina, on Monday, <br />August 12, 1985, at 4:00 P.M. to receive legal counsel regarding the <br />pending lawsuit against the County by Martin Marietta Corporation. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Archie Y. Barnhardt <br /> Marcelle M. Upright <br /> Chairman Lentz stated he wished to discuss the water project of the <br />Water and Sewer District of Cabarrus County and asked if any of the Board <br />members opposed the discussion of the matter at this time. None of the <br />Board members expressed opposition to the discussion of the water project <br />situation. <br /> Chairman Lentz reported that a letter had been received from Bernie A. <br />Edwards, Concord City Mayor and Chairman of the Board of Light and Water <br />Commissioners, declining the County's proposal for the Board of Light and' <br />Water to furnish water service to the residents of the Old South Subdivision <br />for the $6,290.00 in tapping fees committed to the County. He stated there <br />was a need to do something about the water situation in the Old South <br />Subdivision and proposed such possibilities as removing that area from the <br />Farmers Home Administration funding, increasing the line sizes, and placing <br />a loop in the line supplying the subdivision. Chairman Lentz further expressed <br />concern that the water line was planned for the side of the road to be <br />used by the City of Concord for sewer service. He also proposed the <br />elimination of master meters in the water distribution project and the <br />possible utilization of a City of Concord water line which crosses under <br />1-85. <br /> The Board took no action regarding the water project. <br />UPON MOTION of Chairman Lentz, seconded by Commissioner Barnhardt and <br />unanimously carried, the Board moved to go into Executive Session to discuss <br />legal matters with counsel regarding the pending lawsuit by Martin Marietta <br />Corporation. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt <br />and unanimously carried, the Executive Session was terminated. <br /> Chairman Lentz reported that the Board had discussed the pending lawsuit <br />by Martin Marietta Corporation with counsel and that no action had been <br />taken. <br /> There being no further business to come before the Board, the meeting <br />was adjourned at 5:25 P.M. <br /> <br />Clerk to the Board <br /> <br /> <br />
