306 <br /> <br /> The Board of Commissioners for the County of Cabarrus met at the <br />County Courthouse in Concord, North Carolina, on Thursday, October 3, <br />1985, at 7:00 P.M. for a public hearing regarding proposed Zoning Atlas <br />and Text Amendments. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Archie Y. Barnhardt <br /> Marcelle M. Upright <br /> Chairman Lentz announced that a letter had been received from Mr. <br />William G. Alexander, attorney, withdrawing the application to rezone <br />property located in Township 5 on the North side of Highway 73 East. <br />He stated the withdrawal request was recognized and that no action would <br />be taken on this date regarding Petition 85-43. <br /> Mr. William G. Alexander, attorney, advised the Board that the <br />rezoning petition was withdrawn because of the confusion that had occurred <br />when the petitioners had tried to amend the application to apply for a <br />C-2 classification instead of C-3 zone. He stated it was the intent of <br />the petitioners to reapply for a C-2 classification. <br /> Mr. F. A. Rankin, Chairman of the Cabarrus County Planning Board, <br />presented each of the proposed amendments as recommended by the Planning <br />Board. Mr. Michael Byrd, member of the Cabarrus County Planning staff, <br />reviewed the location of the areas proposed for rezoning. Public input <br />was received by the Board prior to action regarding each of the proposed <br />amendments. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(1) Petition 85-43. Withdrawn <br /> <br />(2) <br /> <br />Petition 85-44. First Wesleyan Church, township 4, Gay Street and <br />"J" Avenue, Map/PIN 5613(10)-47-0196, 1122, 1067. Wishes to rezone <br />from R-7.2 to C-3. Planning Board voted 5-0 to approve, felt with <br />the existing commercial uses and the planned Kannapolis loop road, <br />this would be an efficient use of the land. <br /> <br /> There was no one present to speak either for or against the rezoning <br />request. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner <br />Barnhardt and unanimously carried, the Board approved Petition 85-44 <br />by First Wesleyan Church to rezone property on Gay Street and "J" Avenue, <br />Map/PIN 5613(10)-47-0196, 1122, 1067, from R-7.2 to C-3. <br /> <br />(3) <br /> <br />Petition 85-45. Staff request, township 4, Map/PIN 5613(11)-55- <br />3271, 3180, 4002. Wish to rezone from C-2 to C-3. Planning Board <br />voted 4-0 to approve, felt this would be an appropriate land use <br />in this area. <br /> <br /> Mr. Bob Clester spoke in support of the rezoning to allow the <br />location of his business of reshaping pre-mixed rubber on this property. <br />He advised the Board that the business would not produce any noise or <br />odor. <br /> No one spoke in opposition to the rezoning request. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner <br />Barnhardt and unanimously carried, the Board approved Petition 85-45 to <br />rezone property in Township 4, Map/PIN 5613(11)-55-3271, 3180, 4002, from <br />C-2 to C-3. <br /> <br />ZONING TEXT AMENDMENTS <br /> <br />(1) <br /> <br />Petition 85-07. Tabled from September 5, 1985 County Commissioners <br />Public Hearing. Amend Section 3.2-4, page 20, line item Wholesale <br />Storage of Petroleum Products.
