329 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in <br />special session at the County Courthouse in Concord, North Carolina, <br />on Monday, October 28, 1985, at 6:00 P.M. with the Cabarrus County <br />Planning Board for consultation with legal counsel regarding the <br />lawsuit by Martin Marietta Corporation. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: William G. Hamby, Jr. <br /> Archie Y. Barnhardt <br /> Marcelle M. Upright <br /> Absent - Commissioner Kenneth F. Payne <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner <br />Barnhardt and unanimously carried, the Board moved to go into Executive <br />Session with the Planning Board for consultation with legal counsel. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner <br />Barnhardt and unanimously carried, the Board invited Mr. James F. Owens, <br />Assistant Planning Director, and Mr. F. E. Isenhour, Jr., Zoning <br />Administrator, to go into Executive Session with the Board. <br /> UPON MOTION .of Commissioner Hamby, seconded by Commissioner Upright <br />and unanimously carried, the Executive Session was terminated. <br />Chairman Lentz stated that the Board of Commissioners and Planning <br />Board had been in consultation with legal counsel and no action was taken. <br /> There being no further business to come before the Board, the <br />meeting was adjourned. <br /> <br />Clerk to the Board <br /> <br /> <br />
