339 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session at the County Courthouse in Concord, North Carolina, on Monday, <br />December 2, 1985, at 9:30 A.M. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Archie Y. Barnhardt <br /> Marcelle M. Upright <br /> The invocation was given by Reverend Jimmie W. Holland of Royal Oaks <br />United Methodist Church. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner Payne <br />and unanimously carried, the minutes of November 18, 1985, were approved <br />as written. <br /> Mr. Charles D. McGinnis, County Manager, presided over the reorganization <br />of the Cabarrus County Board of Commissioners. <br /> Commissioner Payne nominated Commissioner Lentz for Chairman of the <br />Board. <br /> UPON MOTION of Commissioner Hamby and seconded by Commissioner <br />Barnhardt, nominations were closed. <br /> Commissioner Lentz was elected Chairman of the Board.by unanimous <br />vote. <br /> Commissioner Hamby nominated Commissioner Payne for Vice-Chairman <br />of the Board of Commissioners. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Chairman Lentz <br />and unanimously carried, nominations were closed. <br /> Commissioner Payne was elected Vice-Chairman of the Board by unanimous <br />vote. <br /> Chairman Lentz presided over the remainder of the meeting. <br /> Commissioner Hamby reviewed the following changes to the proposed <br />Fire Protection Resolution as requested by the fire chiefs. <br /> <br />1) Section 1 - Change the amount of County assistance from <br /> $250 to $350 per month. <br />2) Section 4 - Change the word "members" to officers" in the <br /> first sentence. <br />3) Section 5(c) - Add "or retired member" in second sentence. <br />4) Section 5(e) - Omit "leaving the County free from any <br /> responsibility" from the first sentence. <br />5) Section 6(h) - Unless a new Fire Prevention Code is adopted <br /> for the County, add the following at the end of (h): <br /> The term Fire Chief in the county fire prevention <br /> code* shall refer to the county fire marshal. <br /> *American Insurance Association, 1970 edition, <br /> adopted by reference, November 1974. <br />6) Add Contract to Provide Tax District Fire Service. <br /> <br />Commissioner Hamby recommended that the Board accept Changes 2, 3, 5, <br />and 6 as requested by fire chiefs with the provision "attached to this <br />contract" added to Item 4 of the proposed Contract to Provide <br />Tax District Fire Service. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board adopted the following Fire Protection <br />Resolution with Changes 2, 3, 5 and 6. <br /> <br />FIRE PROTECTION RESOLUTION <br /> <br /> Whereas G.S. 153A-233 authorizes a county to maintain a <br />fire department and provide assistance to incorporated volunteer <br />fire departments, and G.S. 153A-234 authorizes a county to employ a <br />fire marshal, whereas the Board of County Commissioners of Cabarrus <br />County has determined that it is in the best interest and necessary <br />for the protection of the citizens of Cabarrus County and their <br />property (a) to encourage and financially aid in the equipment, <br />maintenance, and government of fire departments in the county in order <br />that these departments can more adequately and efficiently protect life, <br />public buildings, homes and other property in Cabarrus County, (b) to <br />establish a fire protection organization to work with and supplement <br />the Cabarrus County Emergency Management organization, (c) to employ a <br />fire marshal to coordinate fire fighting and fire prevention activities <br />under the County's supervision and control, (d) that an annual contract <br />for fire protection is required between Cabarrus County and the fire <br />departments. <br /> <br /> <br />
