389 <br /> <br /> The Board of Commissioners for the County of Cabarrus met at the <br />County Courthouse in Concord, North Carolina, on Thursday, March 6, 1986, <br />at 7:00 P.M. for a public hearing regarding proposed Zoning Atlas and <br />Text Amendments. <br /> Present - Chairman: James W. Lentz ~'~ <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Archie Y. Barnhardt <br /> Marcelle M. Upright <br /> Chairman Lentz proposed that the Board designate the first Thursday <br />of each month as a public hearing meeting for such items as road name <br />changes in addition to zoning matters. The Board by unanimous consent <br />agreed to schedule public hearings for the first Thursday of each month <br />as proposed by Chairman Lentz. It was understood that other public hearings <br />such as those involving industrial revenue bonds could be scheduled by <br />the Board for other meetings. <br /> Mr. F. A. Rankin, Chairman of the Cabarrus County Planning Board, <br />presented each of the proposed amendments as recommended by the Planning <br />Board. Mr. Michael Byrd, member of the County Planning staff, reviewed <br />the location of the areas proposed for rezoning. Public input was <br />received regarding the proposed amendments prior to action by the Board <br />of Commissioners. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(1) <br /> <br />Petition 86-04. Page Realty, Inc., township 4, off 136 By-pass, <br />Map/PIN 5622-36-2513. The original rezoning request was from <br />R-40 to R-7.2; after discussion the Planning Board and Mr. Page <br />agreed to change the rezoning request to R-40 to R-9. The Board <br />voted 4-0 to approve, with Mr. Page abstaining. <br /> <br /> Mr. Ron Page, petitioner, requested the rezoning of approximately <br />12.25 acres of the 19.56-acre tract off Highway 136 from R-40 to <br />R-9/PDO-H. He noted problems with the topographic conditions of the <br />property and stated the PDO-H designation would allow smaller lot sizes <br />as well as permit the side yard flexibility needed for the construction <br />of duplexes on the property. Mr. Page advised the Board that officials of the <br />Royal Oaks Sanitary District had verbally committed to provide water <br />and sewer services to the portion of the property he planned to develop <br />at this time. In conclusion, Mr. Page presented the following commitments <br />for the area of PDO-H use. <br /> <br />e <br /> <br />To proceed with the development of this property in accordance <br />with the PDO-H regulations of Cabarrus County and the plans <br />presented. <br />To place the necessary deed restrictions on this property to <br />protect the natural area within the required buffer. <br />To commit the present owner and future owners to the intent <br />of these plans. <br /> <br /> Mr. Thomas B. Robinson, Planning Director, informed the Board that <br />the advertisement for~the public hearing had been for a R-9 classification. <br />However, he stated in his opinion the Board could approve the R-9/PDO-H <br />request at this time as it was more restrictive than the advertised <br />R-9 classification. Mr. Fletcher L. Hartsell, Jr., County Attorney, <br />concurred with this opinion. <br /> As required by the Zoning Ordinance, Mr. Robinson presented the <br />following report and recommendations regarding the PDO-H request by Mr. <br />Page. <br /> <br />Suitability of the proposal for the type of PDO category, <br />physical characteristics of the land and relation to <br />surrounding development. <br /> <br />Finding: The proposed PDO makes good use of the property, <br />and is compatible with surrounding land use and R-9 zoning. <br /> <br />B. Relation to major roadways and utilities. <br /> <br /> <br />
