396 <br /> <br />Amend present reading to read: <br /> <br /> ...with the first notice to be published not less than ten (10) .... <br /> <br /> There was no one present to speak either for or against this <br />text amendment. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner <br />Barnhardt and unanimously carried, the Board approved Petition 86-04 <br />to amend the third paragraph of Section 9.4-2 to read as follows. <br /> <br /> Such notice shall be published in a newspaper of general circulation <br />in Cabarrus County once a week for two (2) successive weeks, with the <br />first notice to be published not less than ten (10) nor more than twenty- <br />five (25) days, prior to the date of the hearing. <br /> <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board moved that Petition 85-51 be brought <br />off the table for further discussion and action. <br /> A motion was made at the meeting on January 9, 1986, by Commissioner <br />Barnhardt and seconded by Chairman Lentz to approve Petition 85-51 which <br />was presented as follows. <br /> <br />Petition 85-51. Ms. Mary Lee Abernathy, township 10, Map/PIN <br />part of 5535-00-9870. Wishes to rezone from ARR to I-1. The <br />Planning Board voted 5-0 to deny this request, feeling it was <br />inappropriate at this time. <br /> <br /> Mr. William L. Mills, III, attorney representing the owners of <br />H & R Mullis Machine Shop who wish to locate on the property, spoke in <br />favor of the rezoning. He stated the machine shop would be compatible <br />with the existing commercial property in the area. <br />Mr. Jim Martin, area property owner, spoke in support of the rezoning. <br />There was no one present to speak against the rezoning petition. <br />UPON MOTION of Commissioner Barnhardt, seconded.by Chairman Lentz <br />with Commissioners Barnhardt and Upright and Chairman Lentz voting for <br />and Commissioners Hamby and Payne voting against, the Board approved <br />Petition 85-51 by Ms. Mary Lee Abernathy to rezone property in township <br />10, Map/PIN part of 5535-00-9870 from ARR to I-1. <br /> There being no further business to come before the Board, the <br />meeting adjourned at 9:20 P.M. <br /> <br />Clerk to the Board <br /> <br /> <br />
