485 <br /> <br /> (ii) The Allocation will be used within the time limits specified <br />in the document granting the application for the Allocation or within <br />any extension of those limits subsequently granted by the North <br />Carolina Department of Commerce; <br /> (iii) The Board will allow, without contest, any unused portion of <br />the Allocation to revert back to the State of North Carolina for use by <br />other applicants; <br /> (iv) The Board will report, or will cause to be reported, to the <br />North Carolina Department of Commerce the exact principal amount of the <br />Bonds within ten (10) days of the date of issuance. <br /> (v) The Chairman or Vice Chairman of the Board is hereby <br />authorized and directed to execute on behalf of the Board of the "no <br />bribery" certificate attached hereto as Exhibit B. <br /> <br /> Section 3. The appointment by the Authority of Womble Carlyle Sandridge <br />& Rice, Winston-Salem, North Carolina to serve as bond counsel with respect <br />to the issuance of the Bonds and such other bond issues as the Authority may <br />deem appropriate is hereby approved. <br /> <br /> Section 4. The Clerk to the Board of Commissioners for the County of <br />Cabarrus, North Carolina, is directed to file a certified copy of this <br />resolution with the North Carolina Department of Commerce. <br /> <br /> Section 5. This resolution shall take effect immediately upon its <br />passage. <br /> <br />Commissioner Upright moved passage of the foregoing resolution entitled: <br /> <br />RESOLUTION AUTHORIZING THE APPROVAL IN <br />PRINCIPLE OF AN INDUSTRIAL PROJECT IN <br />CABARRUS COUNTY, NORTH CAROLINA, TO BE <br />FINANCED FOR FIELDCREST MILLS, INC., BY THE <br />ISSUANCE OF INDUSTRIAL REVENUE BONDS OF THE <br />CABARRUS COUNTY INDUSTRIAL FACILITIES AND <br />POLLUTION CONTROL FINANCING AUTHORITY IN AN <br />AGGREGATE PRINCIPAL AMOUNT NOT EXCEEDING <br />$1,000,000, AUTHORIZING AN APPLICATION TO <br />THE NORTH CAROLINA DEPARTMENT OF COMMERCE <br />FOR A PRIVATE ACTIVITY BOND ALLOCATION FOR <br />SUCH PROJECT AND BONDS, AND AUTHORIZING THE <br />APPOINTMENT OF WOMBLE CARLYLE SANDRIDGE AND <br />RICE, WINSTON-SALEM, NORTH CAROLINA, AS <br />BOND COUNSEL. <br /> <br />Commissioner Barnhardt seconded the motion, and the resolution was passed by <br />the following vote: <br /> <br />Ayes: Commissioners Lentz, Payne, Barnhardt, Hamby, and Upright <br />Nays: None <br /> <br /> CERTIFICATE OF THE CABARRUS COUNTY <br />BOARD OF COUNTY COMMISSIONERS CONCERNING A <br />REQUEST FOR A PRIVATE ACTIVITY BOND ALLOCATION <br /> <br /> The undersigned officer of the Board of Commissioners of Cabarrus <br />County, hereby certifies under penalty of perjury that the attached appli- <br />cation for allocation of a portion of the State of North Carolina's 1986 <br />private activity bond limit to the Fieldcrest Mills, Inc. project was made in <br />accordance with Executive Order 113 of the Governor of North Carolina dated <br />November 8, 1984 and was not made in consideration of any bribe, gift, <br />gratuity or direct or indirect contribution to any political campaign. <br /> Date: This the 7th day of July, 1986. <br /> <br />BOARD OF COMMISSIONERS <br />OF CABARRUS COUNTY <br />By: /s/ James W.
