504 <br /> <br /> The Board of Commissioners for the County of Cabarrus met at the County <br />Courthouse in Concord, North Carolina, on Thursday, August 7, 1986, at <br />7:00 P.M. for a public hearing regarding the proposed levy of an additional <br />one-half per cent (1/2%) sales tax, naming of an unnamed road to Snow Crest <br />Drive, and Zoning Atlas amendments. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Archie Y. Barnhardt <br /> Marcelle M. Upright <br /> Chairman Lentz opened the public hearing regarding the proposed levy of <br />an additional one-half per cent (1/2%) sales and use tax and asked if anyone <br />were present who wished to speak for or against this proposed increase. <br /> Mr. Bill Bonny of Mt. Pleasant spoke in support of the additional one- <br />half per cent (1/2%) sales tax and stated that the funds were needed for water <br />and sewer capital improvements. He recommended that the funds be earmarked <br />for the completion of the Mt. Pleasant water project and the Coddle Creek <br />Reservoir project. <br /> Dr. Joseph N. Fries, Cabarrus County School Superintendent, stated that <br />the Cabarrus County Board of Education, endorses the County's intent to levy <br />the one-half per cent (1/2%) local option sales tax. <br /> Mr. Troy R. Cook, President of the Farm Bureau, supported the levy of the <br />additional one-half per cent (1/2%) sales tax and stated in his opinion it was <br />one of fairest taxes put on people. He expressed the need for school <br />improvements and water and sewer in the county. <br /> There being no one else who wished to speak regarding the proposed levy <br />of an additional one-half per cent (1/2%) sales tax, Chairman Lentz closed the <br />public hearing at 7:10 P.M. <br /> UPON MOTION of Commissioner Barnhardt, seconded by Commissioner Payne and <br />unanimously carried, the Board adopted the following resolution. <br /> <br />A RESOLUTION LEVYING A ONE-HALF PER CENT (1/2%) ADDITIONAL LOCAL GOVERNMENT <br />SALES AND USE TAX AND PRESCRIBING THE METHOD OF DISTRIBUTION OF THE PROCEEDS <br />WITHIN CABARRUS COUNTY <br /> <br /> WHEREAS, a public hearing was held on August 7, 1986, to consider the <br />levy of a one-half per cent (1/2%) additional local government sales and use <br />tax, and interested citizens presented their views to the Board of County <br />Commissioners; and <br /> <br /> WHEREAS, the Board of County Commissioners caused public notice of the <br />public hearing to be given in accordance with law at least ten days prior to <br />the date of the hearing; and <br /> <br /> WHEREAS, the Board of Commissioners of Cabarrus County is now of opinion <br />and does hereby find and declare that the levy of said sales tax within <br />Cabarrus County is both desirable and necessary to adequately finance the <br />operation of the county and the cities and towns herein; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of <br />Cabarrus County as follows: <br /> <br /> Section 1. There is hereby imposed and levied within Cabarrus County the <br />one-half per cent (1/2%) supplemental local government sales and use tax <br />authorized by Ratified Chapter 906 of the 1985 Session Laws (Regular Session, <br />1986), and codified as Article 42 of Chapter 105 of the General Statutes of <br />North Carolina, effective July 7, 1986. The tax hereby imposed and levied <br />shall apply to the same extent and be subject to the same limitations as are <br />set forth in said Chapter 105. <br /> <br /> Section 2. Collection of the tax by the North Carolina Secretary of <br />Revenue, and liability therefor, shall begin and continue on and after the <br />first day of October 1, 1986. <br /> <br /> Section 3. The net proceeds of the tax levied herein shall be dis- <br />tributed by the Secretary of Revenue on a quarterly basis to Cabarrus County <br />as prescribed by G.S. 105-501. The amount distributed to Cabarrus County <br />shall be divided among the County and the municipalities herein in accordance <br />with the method by which the one percent (1%) sales and use taxes levied in <br />Cabarrus County pursuant to Article 39 of General Statutes Chapter 105 are <br />distributed. <br /> <br /> <br />
