A. Artz to rezone property in Township 4, Map/PIN 5604(20)-92-5398, from <br />R-9 to RMF-7. <br /> Commissioner Hamby left the meeting at this time and was absent for the <br />remainder of the meeting. <br /> <br />(2) <br /> <br />Petition 86-19. Harry Leslie Smith, off Danlow Street and Briarcliff <br />Drive, township 4, Map/PIN 5612(11)-77-3100. Wishes to rezone from R-9 <br />to O-I. The Planning Board voted 4-0 to deny this petition. <br /> <br /> Ms. Frances Moss, resident of the area, spoke in opposition to the <br />rezoning. <br /> No one else was present to speak for or against the rezoning request, and <br />the public hearing was closed. <br /> It was noted that the proposed rezoning was not in compliance with the <br />Land Development Plan for the City of Kannapolis. <br /> UPON MOTION of Commissioner Upright, seconded by Commissioner Payne and <br />unanimously carried, the Board denied Petition 86-19 by Harry Leslie Smith to <br />rezone property in Township 4, Map/PIN 5612(11)-77-3100, from R-9 to O-I. <br /> <br />(3) <br /> <br />Petition 86-23 Planning staff request Map 5622-22-1103, township 4, to <br />be zoned C-2. Extraterritorial Boundary for City of Concord to be <br />corrected on the remainder of Map 5622. <br /> <br /> The areas shown highlighted on this map were originally shown as <br />being included in the extraterritorial jurisdiction of Concord. The <br />extraterritorial jurisdiction of Concord runs 200' north of the center- <br />line of 1-85, which negates the area shown in their extraterritorial <br />jurisdiction. This area was mapped in error at the time the original <br />overlays were done. <br /> <br /> The revised map shows the county zoning proposed for this area as it <br />originally should have been mapped. With the construction in progress at <br />the Cloverleaf Shopping Center, this amendment needs to be acted on at <br />the July meeting. <br /> <br /> Mr. Michael Byrd, member of the County Planning staff, addressed the <br />Board stating that the original zoning overlay map did not concur with the <br />Concord extraterritorial jurisdiction north of 1-85. He stated the Planning <br />staff had revised the zoning overlay map of the area and was requesting the <br />Board to approve this zoning atlas amendment as presented. He further pointed <br />out that a portion of the area known as the Cloverleaf Shopping Center had <br />never been zoned and that Map 5622-22-1103 should be zoned C-2 to correct this <br />error in the Zoning Atlas. <br /> There was no one present to speak for or against the amendment, and the <br />public hearing was closed. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Payne and unani- <br />mously carried, the Board approved Petition 86-23 as a Zoning Atlas amendment <br />requested by the Planning staff. Map 5622-22-1103, Township 4, was zoned C-2 <br />and the section of Map 5622 showing the extraterritorial jurisdiction for the <br />City of Concord was corrected to show revised County zoning lines adjoining <br />the north side of the 1-85 right-of-way. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt and <br />unanimously carried, the Board moved to go into Executive Session to consider <br />property acquisition. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt and <br />unanimously carried, the Executive Session was terminated. <br /> <br /> <br />
