513 <br /> <br /> The Board of Commissioners for the County of Cabarrus met at the County <br />Courthouse in Concord, North Carolina, at 7:00 P.M. on Thursday, September 4, <br />1986, for a public hearing on Zoning Atlas and Text amendments, a Minimum <br />Housing Code Text amendment, and the Cabarrus County Thoroughfare Plan as <br />proposed by the North Carolina Department of Transportation. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Archie Y. Barnhardt <br /> Marcelle M. Upright <br /> Mr. F. A. Rankin, Jr., Chairman of the Cabarrus County Planning Board, <br />presented each of the proposed Zoning Atlas amendments as approved by the <br />Planning Board. Mr. Phillip Kingsland, member of the Planning staff, <br />reviewed the location of each of the areas proposed for rezoning. Public <br />input was received prior to action by the Board of Commissioners. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(1) <br /> <br />Petition 86-21. Betty Gay Bivens, off Rock Hill Church Road, <br />township 2, Map/PIN 5610-36-2367. Wishes to rezone from R-40 to R-15. <br />Planning Board voted to approve 5-0. <br /> <br /> Mr. Howard Hurlocker stated he proposed to purchase the property for the <br />development of five residential lots. He pointed out that County water was <br />available at the site and that Rock Hill Church Road had recently been <br />widened and improved by the Department of Transportation. <br /> Mr. Tom Small of Brown Realty Company and representing Ms. Betty Gay <br />Bivens reported that adjacent property owners had been contacted regarding <br />the proposed rezoning and all were in consent to the rezoning. There was no one present to speak against the petition. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhardt <br />and unanimously carried, the Board approved Petition 86-21 by Betty Gay <br />Bivens to rezone property off Rock Hill Church Road, Map/PIN 5610-36-2367, <br />from R-40 to R-15. <br /> <br />(2) <br /> <br />Petition 86-22. A.J. Blackwelder, off Highway 29, township 2, Map/PIN <br />5509-22-5546, 5509(17)-22-4014, 1084. Wishes to rezone from A-I to C-4. <br />Planning Staff wishes the Board to consider rezoning to I-1. Planning <br />Board voted to deny 5-0. <br /> <br /> Mr. Rankin explained that the Planning Board had voted to deny the <br />request to rezone the property from A-I to C~4 as the petitioner had not been <br />present at the Planning Board meeting to authorize the change to I-1. <br /> Mr. A. J. Blackwelder, petitioner, stated that the proposed I-1 classi- <br />fication would meet his needs and that he was in agreement to the proposed <br />rezoning to I-1 as recommended by the Planning staff. <br /> Mr. Fletcher L. Hartsell, Jr., County Attorney, stated in his opinion <br />the rezoning petition was advertised in such a way to permit the Board to <br />consider rezoning to I-1. <br /> There was no one present to speak against the rezoning request. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Payne and <br />unanimously carried, the Board approved Petition 86-22 by Mr. A. J. <br />Blackwelder and rezoned the property off Highway 29, Map/PIN 5509-22-5546, <br />5509(17)-22-4014, 1084, from A-I to I-1. <br /> <br />(3) <br /> <br />Petition 86-24. John Wayne Josey, off South Ridge Avenue, township 4, <br />Map/PIN 5613(11)-55-7502, 7416, 7412. Wishes to rezone from R-7.2 to <br />C-3. Planning Board voted to deny 5-0. <br /> <br /> Ms. Mildred Fisher, resident of the community, spoke in support of the <br />back portion of the property being zoned C-3 and asked that the front portion <br />of the property remain zoned residential. <br /> Friends and neighbors speaking in support of Mr. Josey and his request <br />for rezoning included Messrs. Guy Adkins, R. B. Moose, Ken Grimer, and David <br />Fisher. <br /> Mr. Farrar Griggs, attorney representing Mr. Josey, presented a survey <br />of the property and asked that the portion of the property from the chain <br />link fence to the rear of the property at the railroad tracks be rezoned C-3. <br />He also presented a petition signed by residents of South Ridge Avenue <br />stating they "support and endorse the Petition to allow Mr. Josey to have a <br />portion of his property rezoned to a designation of C-3". <br /> <br /> <br />
