48 <br /> <br /> There was no one present to speak either for or against the proposed <br />amendment. <br /> UPON MOTION of Commissioner Payne, seconded by Chairman Lentz and <br />unanimously carried, the Board adopted the following amendments to the <br />Cabarrus County Subdivision Ordinance. <br /> <br />Section 1.4, Compliance with Ordinance Required, page 2 <br />First paragraph add sentence to read: <br />Letters of credit or other documents filed with the Planning Department <br />shall be completed upon forms provided by the Planning Department and <br />approved by the County Attorney and/or the Planning Department and shall <br />be submitted at least fourteen (14) days prior to the meetings date set <br />forth in the subdivision regulations. <br /> <br />Section 4.9, Roads, page 21 Item (6) Reserved <br />Amend to read: <br />The developer shall bear the cost and the county shall install street <br />signs at all intersections as shown on the final plat. <br /> <br />Section 4.9, Roads, page 23, Subsection E <br />Add sentence to read at the end of subsection E: <br />If the proposed or existing lot density is greater than two (2) lots per <br />1/10th of a mile, then these private road provisions shall not be used. <br /> <br /> At 7:30 P.M., Chairman Lentz stated that this was the day and hour <br />scheduled for a public hearing for the revised County Floodplain Ordinance <br />and asked if anyone were present who wished to speak for or against this <br />revised Ordinance. No one spoke in regards to the revised County Floodplain <br />Ordinance. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Melvin and <br />unanimously carried, the Board adopted the following revised County <br />Floodplain Ordinance. <br /> <br />FLOOD DAMAGE PREVENTION ORDINANCE <br /> <br />ARTICLE 1. STATUTORY AUTHORIZATION, FINDINGS OF FACT, <br /> PURPOSE AND OBJECTIVES. <br /> <br />SECTION A. STATUTORY AUTHORIZATION <br /> <br />The legislature of the State of North Carolina has in Chapter 153A-121 of <br />N. C. General Statues, delegated the responsibility to local governmental <br />units to adopt regulations designed to promote the public health, safety, and <br />general welfare of its citizenry. Therefore, the County Commissioners of <br />Cabarrus County, North Carolina, do ordain as follows: <br /> <br />SECTION B. FINDINGS OF FACT. <br /> <br /> 1. The flood hazard areas of Cabarrus County are subject to periodic <br />inundation which results in loss of life and property, health and safety <br />hazards, disruption of commerce and governmental services, and extraordinary <br />public expenditures for flood protection and relief, and impairment of the <br />tax base, all of which adversely affect the public health, safety, and <br />general welfare. <br /> 2. These flood losses are caused by the cumulative effect of obstruc- <br />tions in floodplains causing increases in flood heights and velocities, and <br />by the occupancy in flood hazard areas by uses vulnerable to floods or <br />hazardous to other lands which are inadequately elevated, floodproofed, or <br />otherwise unprotected from flood damages. <br /> <br />SECTION C. STATEMENT OF PURPOSE. <br /> <br />It is the purpose of this ordinance to promote the public health, safety and <br />general welfare and to minimize public and private losses due to flood <br />conditions in specific areas by provisions designed to: <br /> <br /> 1. Restrict and prohibit uses which are dangerous to health, safety and <br />property due to water or erosion or in flood heights or velocities; <br /> 2. Require that uses vulnerable to floods, including facilities which <br />serve such uses, be protected against flood damage at the time of initial <br />construction; <br /> <br /> <br />
