44 <br /> <br /> Mr. Samuel F. Davis, Jr., attorney representing the petitioner and Pepsi <br />Cola Bottling Company of Charlotte, Inc., who has agreed to purchase the <br />property if it is rezoned, reviewed the rezoning request and asked that the <br />property be rezoned to either C-3 or I-i(PDO). He stated that it was the <br />intent of Pepsi Cola Bottling Company of Charlotte, Inc., to build a ware- <br />house and distribution facility on the property for the distribution of soft <br />drinks. <br /> Mr. Warren Helms, adjoining property owner, stated in his opinion the <br />requested rezoning would be spot zoning and he was against spot zoning. <br /> Motion was made by Commissioner Melvin and seconded by Commissioner <br />Payne to approve the property, Map/PIN 5555-40-8829, 51-1671, for I-i(PDO) to <br />be used for bottling works, warehousing, and wholesaling only and if the <br />property sells before facility is built the property will revert back to A-2 <br />within 60 days. No vote was taken on this motion. <br /> UPON SUBSTITUTE MOTION of Chairman Lentz, seconded by Commissioner Hamby <br />with Chairman Lentz and Commissioners Payne and Hamby voting for and <br />Commissioners Melvin and Moss voting against, the Board approved Petition <br />86-35 by Mary Welch to rezone property off Highway 24/27, Map/PIN 5555-40-8829, <br />51-1671, from A-2 to I-i(PDO) subject to the following conditions and <br />performance standards as recommended by the Planning Director in the I-I(PD0) <br />Rezoning Report. <br /> <br />(1) Permitted Uses: Ail uses permitted in the underlying I-1 District <br /> which also meet the following requirement: <br /> <br />Industrial uses of land and building for administration, research, <br />manufacturing, processing, fabrication, assembly, freight handling, <br />storage, distribution, and similar operations. <br /> <br />(2) <br /> <br />Required Lot Area: A six acre minimum lot size is required. Only <br />one principal use shall be allowed per lot or tract. Average lot <br />width shall not be less than 400 feet. <br /> <br />(3) <br /> <br />(4) <br /> <br />(5) <br /> <br />BuildinK Heisht Limit: Fifty feet. <br /> <br />Lot CoveraKe: The maximum lot coverage by total impervious surfaces <br />such as roof tops, paving, walkways, etc., shall be thirty (30%) <br />percent of the lot area. Maximum lot coverage may be increased to <br />forty (40%) percent if additional runoff (above 30%) is compensated <br />for by on-site detention or retention measures. <br /> <br />Yards: <br /> <br />Required front yard. <br />a. One hundred feet from base setback line of the <br /> right-of-way of an Interstate or other highway. <br />b. Fifty feet from the edge of the right-of-way of an access <br /> road if access points are onto an access road. <br />c. If an access road (frontage road) runs parallel to an <br /> Interstate or other major highway on or in proximity to <br /> the right-of-way, then the requirement which results in <br /> greater yard depth (not to exceed 100 feet from the <br /> right-of-way) shall control. <br />Rear and side yard requirements. <br />a. Minimum depth of rear yard - 50 feet; but 100 feet from <br /> the edge of the right-of-way when a rear yard is adjacent <br /> to an Interstate or other highway. <br />b. Minimum width of side yard - 50 feet; but 100 feet on the <br /> side adjacent to an Interstate or other highway. <br />Permitted yard usage. <br />a. Boundary fences, gates and security stations may be <br /> located in any required yard. <br />b. Parking and loading shall not be permitted in any <br /> required front yard or within 100 feet from the edge of <br /> the right-of-way of a special highway, or in any corner <br /> side yard, or within fifty (50) feet of any interior lot <br /> line. <br />Special Uses.
