<br /> The Board of Commissioners for the County of Cabarrus met in regular
<br />session at the County Courthouse in Concord, North Carolina, on Monday,
<br />July 20, 1987, at 7:00 P.M.
<br /> Present - Chairman: James W. Lentz
<br /> Commissioners: Kenneth F. Payne
<br /> William G. Hamby, Jr.
<br /> Martha H. Melvin
<br /> R. Giles Moss
<br /> The invocation was given by Reverend Andy Anderson of Bethlehem Baptist
<br />Church.
<br /> The minutes of June 4, 1987, were corrected to read as follows:

<br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Payne
<br />and unanimously carried, the Executive Session was terminated.
<br />
<br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Melvin and
<br />unanimously carried, the minutes of June 4, 1987, were approved as corrected
<br />and the minutes of June 8, June 9, and June 15, 1987, were approved as written.
<br /> At 7:00 P.M., Chairman Lentz stated that the public hearing for the
<br />proposed Zoning Text and Atlas amendments would be held at this time.
<br /> Mr. Larry Loving, Chairman of the Cabarrus County Planning Board,
<br />presented each of the proposed Zoning Text and Atlas amendments as recommended
<br />by the Planning Board. Public input was received prior to action by the Board
<br />of Commissioners.

<br />ZONING TEXT AMENDMENT

<br />Petition 87-06. Section Number 3.2-4, Schedule of Use Regulations.
<br />Delete Mobile Home Sales Retail from C-3 Zone. Add Mobile Home Sales
<br />Retail to C-4 Zone. Planning Board voted unanimously to recommend
<br />approval.
<br />
<br />There was no one present to speak for or against the proposed amendment.
<br />UPON MOTION of Commissioner Payne, seconded by Commissioner Melvin with
<br />Commissioners Payne, Melvin, and Hamby and Chairman Lentz voting for and
<br />Commissioner Moss voting against, the Board approved Petition 87-06 to amend
<br />Section Number 3.2-4, Schedule of Use Regulations, of the Cabarrus County
<br />Zoning Ordinance as follows:

<br />Delete Mobile Home Sales Retail from C-3 Zone. Add Mobile Home Sales
<br />Retail to C-4 Zone.

<br />ZONING ATLAS AMENDMENT
<br />

<br />
<br />Petition 87-20. Jeffery Carter, off Lake Lynn Road, township 11,
<br />Map/PIN 5640-67-6455. Wishes to rezone from ARR to I-1. Planning Board
<br />voted unanimously to recommend denial.
<br />
<br /> Mr. James F. Owens, Planning Director, reported that Mr. Jeffery Carter,
<br />petitioner, only needed two acres of the twelve-acre tract rezoned to I-1 to
<br />establish a small machine type business and that Mr. Carter was in agreement
<br />for the petition to be sent back to the Planning Board to define the metes
<br />and bounds of the two-acre tract and for the Planning Board to approve a
<br />Planned Development Overlay (PDO) for this portion of the property. Mr.
<br />Carter, who was present for the meeting, concurred with this recommendation.
<br /> UPON MOTION of Commissioner Payne, seconded by Chairman Lentz and unani-
<br />mously carried, the Board moved that Petition 87-20 by Jeffery Carter be sent
<br />back to the Planning Board for further development.

<br />Petition 87-21. George Bender, Inc., off Lane Street, township 5,
<br />Map/PIN 5634-30-5090. Wishes to rezone from C-4 to C-3. Planning Board
<br />voted unanimously to recommend denial, due to previous action taken on
<br />text amendment.
<br />
<br /> Mr. Clifford Brown, representative of George Bender, Inc., requested the
<br />withdrawal of Petition 87-21 as he stated approval of Petition 87-06 amending
<br />the Zoning Text would allow the company to do what it wished to do with the
<br />property.
<br /> The Board acknowledged the withdrawal of Petition 87-21.
