154 The Board reviewed the request from the City of Concord for a permanent right-of-way and a temporary construction easement across County property to install a water line. The City proposed to pay $731.08 for this right-of-way. UPON MOTION of Commissioner Hamby, seconded by Cox~issioner Moss and unanimously carried, the Board granted a right-of-way to the City of Concord at a cost of $731.08. The legal description of the right-of-way as granted by the Board is as follows. LYING ~ BEING in Number 11 Township, Cabarrus County, North Carolina, on the West side of U.S. Highway 601 Bypass and being, a water line easement 15 feet in width, lying on the North side of and being parallel with and adjacent to a 20 foot sewer right-of-way granted to Phillip Morris USA as recorded in Map Book 18 Page 79 of the Cabarrus County Registry. Beginning at a point in the Eastern right-of-way line of Union Cemetery Road (said point being North 51-54-38 East, 30.28 feet; thence North 30-14-11 West, 71.33 feet from and existing railroad spike in the center of Union Cemetery Road) and runs thence North 51-54-35 East, 644.62 feet to a point in the Western right-of-way line of U.S. Highway 601 Bypass. Said easement being 15 feet in width the Southern Boundary being 5 feet from and parallel with and the Northern Boundary being 10 feet from and parallel with the above described center line. TOGETHER with a construction easement 20 feet in width adjoining the aforesaid right-of-way, lying on the north side of said right-of-way. See plat prepared by Concord Engineering and Surveying, Inc., a copy of which plat is attached hereto. The plat prepared by Concord Engineering and Surveying, Inc., is on file in the County Manager's Office at the County Courthouse and is included by reference as a part of the minutes. UPON MOTION of Commissioner Melvin, seconded by Commissioner Hamby and unanimously carried, the Board adopted the following Community Development Code of Conduct and a Fair Housing Resolution. CABARRUS COUNTY COMMUNITY DEVELOPMENT CODE OF CONDUCT HATCH ACT No employee or agent of the County may perform any function during work hours that is considered political activity. This includes: Soliciting votes, transporting voters, distributing campaign materials, working on or developing campaign materials, etc. DISCRIMINATION No person shall, on the grounds of race, color, national origin, handicap or sex be excluded from participation in, be denied the benefits of, or subject to discrimination under any program or activity funded in whole or in part with Community Development funds. ENGAGEMENT IN PROCUREMENT No employee, officer or agent of Cabarrus County shall participate in the selection or award of administration of a contract supported by federal funds if a conflict of interest, real or apparent would be involved. Such a conflict would arise when: a) b) c) d) The employee, officer, or agent; Any member of his immediate family; His or her partner; or An organization which employs or is about to employ, any of the above, has a financial or other interest in the firm selected for award.
