154 <br /> <br /> The Board reviewed the request from the City of Concord for a permanent <br />right-of-way and a temporary construction easement across County property to <br />install a water line. The City proposed to pay $731.08 for this right-of-way. <br /> UPON MOTION of Commissioner Hamby, seconded by Cox~issioner Moss and <br />unanimously carried, the Board granted a right-of-way to the City of Concord at <br />a cost of $731.08. The legal description of the right-of-way as granted by the <br />Board is as follows. <br /> <br />LYING ~ BEING in Number 11 Township, Cabarrus County, North Carolina, <br />on the West side of U.S. Highway 601 Bypass and being, a water line <br />easement 15 feet in width, lying on the North side of and being parallel <br />with and adjacent to a 20 foot sewer right-of-way granted to Phillip <br />Morris USA as recorded in Map Book 18 Page 79 of the Cabarrus County <br />Registry. <br /> <br />Beginning at a point in the Eastern right-of-way line of Union Cemetery <br />Road (said point being North 51-54-38 East, 30.28 feet; thence North <br />30-14-11 West, 71.33 feet from and existing railroad spike in the center <br />of Union Cemetery Road) and runs thence North 51-54-35 East, 644.62 feet <br />to a point in the Western right-of-way line of U.S. Highway 601 Bypass. <br /> <br />Said easement being 15 feet in width the Southern Boundary being 5 feet <br />from and parallel with and the Northern Boundary being 10 feet from and <br />parallel with the above described center line. <br /> <br />TOGETHER with a construction easement 20 feet in width adjoining the <br />aforesaid right-of-way, lying on the north side of said right-of-way. <br /> <br />See plat prepared by Concord Engineering and Surveying, Inc., a copy of <br />which plat is attached hereto. <br /> <br /> The plat prepared by Concord Engineering and Surveying, Inc., is on file <br />in the County Manager's Office at the County Courthouse and is included by <br />reference as a part of the minutes. <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Hamby and <br />unanimously carried, the Board adopted the following Community Development Code <br />of Conduct and a Fair Housing Resolution. <br /> <br /> CABARRUS COUNTY <br />COMMUNITY DEVELOPMENT CODE OF CONDUCT <br /> <br />HATCH ACT <br /> <br /> No employee or agent of the County may perform any function during <br />work hours that is considered political activity. This includes: <br />Soliciting votes, transporting voters, distributing campaign materials, <br />working on or developing campaign materials, etc. <br /> <br />DISCRIMINATION <br /> <br /> No person shall, on the grounds of race, color, national origin, <br />handicap or sex be excluded from participation in, be denied the benefits <br />of, or subject to discrimination under any program or activity funded in <br />whole or in part with Community Development funds. <br /> <br />ENGAGEMENT IN PROCUREMENT <br /> <br /> No employee, officer or agent of Cabarrus County shall participate in <br />the selection or award of administration of a contract supported by <br />federal funds if a conflict of interest, real or apparent would be <br />involved. Such a conflict would arise when: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />The employee, officer, or agent; <br />Any member of his immediate family; <br />His or her partner; or <br />An organization which employs or is about to employ, <br />any of the above, has a financial or other interest <br />in the firm selected for award. <br /> <br /> <br />
