287 <br /> <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Payne and unani- <br />mously carried, the Board by resolution changed the first regular meeting in <br />March from 3:00 P.M. on March 7 to 3:00 P.M. on March 14, 1988. Board members <br />will be attending the NACo Legislative Conference in Washington, D.C., on <br />March 7, 1988. <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Melvin and <br />unanimously carried, the Board adopted the following Resolution Declaring <br />Intent to Close Easements for a Neighborhood Road with publication of public <br />hearing notice contingent upon the receipt of $175.00 in advance of the first <br />publication date. <br /> <br />NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br />RESOLUTION DECLARING INTENT TO CLOSE <br />EASEMENTS FOR A NEIGHBORHOOD ROAD <br /> <br /> WHEREAS, at the January 18, 1988, meeting of the Board of Commissioners <br />for Cabarrus county ("the Board"), the Board acknowledged a Petition to adopt <br />a resolution and order closing a portion of Sand Clay Road described by the <br />petitioner as follows: <br /> <br /> BEGINNING at an existing iron pin being a common corner of <br />Davis, Tommy Freeman, George C. Blount, et al, and Hartsell tracts, <br />all being located in Number Two Township, Cabarrus County, North <br />Carolina; thence with a common line of Hartsell and George C. <br />Blount, et al, N. 67-26-00 W. 44.87 feet to an existing iron pin <br />being situated S. 67-26-00 E. 34.54 feet from an existing iron pin <br />in the eastern right-of-way line in Ivey Cline Road; thence with <br />the old western right-of-way line of Sand Clay Road N. 28-10-19 E. <br />557.04 feet to a new iron pin in the western right-of-way line, the <br />1-85 service ramp; thence S. 9-29-09 W. 42.79 feet to an existing <br />iron pin; thence with said right-of-way S. 7-48-22 W. 88.93 feet to <br />an existing iron pin; thence along the eastern right-of-way of Sand <br />Clay Road S. 28-10-19 W. 428.75 feet to the point and place of <br />BEGINNING, and containing 0.504 acres, all of which is lying within <br />an abandoned 44-foot right-of-way, all as shown on a survey by Jack <br />R. Christian and Associates dated October 9, 1987. <br /> <br /> WHEREAS, the Board desires to notify the public regarding said public <br />hearing on the issue of closing the said portion of Sand Clay Road described <br />above. <br /> <br />BE IT, THEREFORE, RESOLVED that: <br /> <br /> 1. A meeting and public hearing on the closing of the portion of Sand <br />Clay Road described above shall be held before the Board on the 21st day of <br />March, 1988, at 7:00 p.m., or as soon thereafter as persons may be heard. <br /> <br /> 2. This resolution declaring the Board's intent to close easements <br />described above for Sand Clay Road shall be published in The Concord <br />Tribune on Monday, February 22 and 29, and March 7 and 14, 1988, and <br />shall be prominently posted in at least two (2) places along the portion <br />of Sand Clay Road petitioned to be closed. <br /> <br /> 3. At said hearing, the Board shall hear all interested parties who <br />appear with respect with whether the closing will be detrimental to the public <br />interest or to any individual property rights. <br /> <br />This the 1st day of February, 1988. <br /> <br />ATTEST: <br />/s/ Frankie F. Mr. Walter C. Odell, III, County Engineer, and Mr. <br />Paul Watson, Engineer with }{DR Infrastructure, Inc., were invited to join the <br />Board in Executive Session. <br /> <br /> <br />
