294 <br /> <br /> (d) That the South Concord Sanitary District has no outstanding <br />indebtedness. <br /> (e) That said petition was duly signed by 95 resident freeholders <br />residing within the boundaries of the sanitary district. That there are 135 <br />resident freeholders within the boundaries of said sanitary district, and that <br />the number of resident freeholders who signed said petition is more than <br />fifty-one per cent (51%) of the freeholders residing within the proposed <br />district. <br /> (f) That the petition requests the Board of Commissioners to take all <br />necessary steps required by Section 73 of Chapter 130A of the General Statutes <br />of North Carolina for the dissolution of a sanitary district. <br /> <br /> Section 2. That the Board of County Commissioners, through its Chairman, <br />notify the Department of Human Resources, and the Mayor and the Board of <br />Aldermen of the City of Concord, of the receipt of said petition and request <br />that a representative of the Department of Human Resources hold a joint <br />hearing with the County Commissioners of Cabarrus County and the Mayor and <br />Board of Aldermen of the City of Concord concerning the dissolution of the <br />South Concord Sanitary District. <br /> <br /> Section 3. That the Chairman of the Board of County Commissioners, the <br />Mayor of the City of Concord, and the Secretary of the Department of Human <br />Resources name a suitable time, place and date for said joint public hearing, <br />said place to be within the boundaries of the South Concord Sanitary District <br />and the City of Concord. <br /> <br /> Section 4. That the Chairman of the Board of County Commissioners, upon <br />agreement with the Secretary of the Department of Human Resources and the <br />Mayor of the City of Concord as to the time and place of said public hearing, <br />give prior notice of such hearing by posting a notice at the Courthouse door <br />of Cabarrus County and also by publication of such notice in the Concord <br />Tribune, a newspaper published in Cabarrus County, North Carolina. <br /> <br /> Section 5. That a joint public hearing shall be held by the Board of <br />Commissioners of the County of Cabarrus with the Mayor and Board of Aldermen <br />of the City of Concord and a representative of the North Carolina Department <br />of Human Resources at such time and place as is agreed upon by the Chairman of <br />the Board of County Commissioners, the Secretary of the Department of Human <br />Resources, and the Mayor of the City of Concord, at which time and place any <br />freeholder within the South Concord Sanitary District or other interested <br />person may appear and be heard. <br /> <br /> Commissioner Hamby moved the passage of the foregoing resolution entitled <br />"RESOLUTION RELATING TO THE DISSOLUTION OF THE SOUTH CONCORD SANITARY <br />DISTRICT", and Commissioner Melvin seconded the motion, and the resolution was <br />passed by the following vote: <br /> <br />Ayes: Commissioners Hamby, Melvin, Payne, and Moss and Chairman Lentz <br />Noes: None <br /> <br /> Ms. Tish Harris, Executive Director of the Cabarrus Arts Council, pre- <br />sented a report on the state of the arts in Cabarrus County and reviewed the <br />funding process for the Council. <br /> Mr. Walter C. Odell, III, County Engineer, presented a petition from <br />residents of Miami Church Road requesting extension of water service. He <br />reported that based on the number of financial commitments, the extension <br />would only be feasible to be constructed from U. S. Highway 601 to the Country <br />Home Road and a shOrt section of Country HomeRoad. Mr. Odell further <br />reported that commitments totaling $59,500.00 of the estimated $88,320.00 <br />required had been raised by 10 of the 17 affected property owners. In con- <br />clusion, Mr. Odell made the following recommendations: <br /> <br />1) <br /> <br />2) <br /> <br />3) <br /> <br />That the Board of County Commissioners approve the construction of <br />this project. <br />That Cabarrus County through its county wide Utility System provide <br />necessary funds to be added to those funds committed by the <br />residents to fund the project. <br />That those residents that need to do so be allowed to finance their <br />total contribution to the project excluding the cost of the service <br />connection. <br /> <br /> <br />
