333 <br /> <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Payne and <br />unanimously carried, the Board approved Zoning Text Amendment Petition 88-05 <br />as follows. <br /> <br />Schedule of Use Regulations. <br />ll-H, Race Shops. <br /> A-I ARR A-2 <br /> C C C <br /> <br />Add new line item to Section 3.2-4, Page <br /> <br /> I-1 I-2 C-3 <br /> P P P <br /> <br />Add Section 9.7-23, Race Shops <br /> <br />9.7-23 Race Shops <br /> <br />A. Intent: It is the intent of this Conditional Use to allow for race shops <br />and their accessory uses when the principle use of the property is for the <br />construction, building, rebuilding or repair of race vehicles.and the parts <br />involved with these race vehicles. The use must be found to be compatible <br />with existing land uses, and shall not have an adverse impact on the health, <br />safety, and welfare of nearby residents, property owners, and of the <br />community as a whole. The burden of proof of such compatibility shall rest <br />with the applicant and the second part of Section 9.2-1 (C) shall not apply <br />in the granting of this conditional use. <br /> <br />B. Additional Requirements: <br /> <br />Minimum Lot Area. The minimum lot area for the conditional use <br />allowed in this section shall be five (5) acres. Larger acreage <br />may be necessary for larger operation, and the Board of Adjustment <br />must find as a fact that the amount of property for the proposed <br />use is adequate to maintain the general welfare of the surrounding <br />community and that the acreage is of sufficient amount to maintain <br />or enhance the value of contiguous property owners. <br /> <br />Principal and Accessory Uses. The Race Complex will be considered <br />as the principle use under this permit. Accessory uses are <br />permitted when it can be proven by the applicant that the accessory <br />use is necessary for the broad operation of the Race Team. <br />Accessory uses may include, but are not limited to, Engine Rooms, <br />Sheet Metal Shops, Storage Facilities, Housing, Conference <br />Facilities, Storage of souvenirs, airplane hangars, etc. <br /> <br />Public Road Frontage. The lot shall front on a public road in <br />compliance with the Schedule of Development Standards. <br /> <br />Yard Requirements. The following yard requirements shall be met <br />for all buildings and open areas when equipment may be stored or <br />tested. <br /> <br />Minimum setbacks from all public streets, roads and highways <br />shall be based on the size of the Race Complex on the lot and <br />shall not be less than the following minimum specification: <br /> <br />Minimum Setbacks (in feet) <br /> <br />Front 50' Side 40' Rear 40' <br /> <br />The front and side yard setback areas shall be left in an <br />undisturbed natural setting. If grading occurs such front <br />and/or side yard area must be sown with grass including straw <br />of sufficient quantity to insure a strong stand. <br /> <br />Enclosed Facilities. Ail manufacturing, testing, office and <br />activities shall be conducted within an enclosed building. <br /> <br />Outside Storage. Outside storage will be permitted, but shall be <br />completely screened on all sides by plantings in accordance with <br />Section 5.10. Storage will not be permitted in the front yard. <br /> <br />Off-Street Parking and Loading. Off-street parking and loading <br />shall be provided in accordance with the standards set forth in <br /> <br /> <br />
