440 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session at the County Courthouse in Concord, North Carolina, on Monday, <br />July 18, 1988, at 7:00 P.M. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: Kenneth F. Payne <br /> William G. Hamby, Jr. <br /> Martha H. Melvin <br /> R. Giles Moss <br /> The invocation was given by Reverend Larry E. Irvin of the Church of the <br />Living Word. <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Payne and <br />unanimously carried, the minutes of June 16, 20, 21, 27, and 28, 1988, were <br />approved as written. <br /> Chairman Lentz stated that this was the day and hour scheduled for a <br />public hearing regarding the proposed Zoning Atlas and Text amendments. <br /> Mr. Larry Loving, Chairman of the Cabarrus County Planning Board, <br />presented each of the proposed Zoning Atlas and Text amendments as recom- <br />mended by the Planning Board. Mr. Jonathan Marshall, member of the Planning <br />Department staff, reviewed the location of the areas proposed for rezoning. <br />Public input was received regarding the proposed amendments prior to action <br />by the Board of Commissioners. <br /> <br />ZONING ATLAS AMENDMENTS <br /> <br />(1) <br /> <br />Petition 88-10. Whitley Manufacturing, off Highway 601 South at Whitley <br />Road, township 10, Ma~/PIN 5543-96-1540. Wishes to rezone from I-X to <br />I-1. Planning Board voted 5-0 to approve this petition. <br /> <br /> Mr. James Scarbrough, attorney representing Whitley Manufacturing, spoke <br />in support of the rezoning request. <br /> No one spoke against the proposed rezoning, and the public hearing for <br />Petition 88-10 was closed. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Moss and <br />unanimously carried, the Board approved Petition 88-10 by Whitley Manufactur- <br />ing to rezone property off Highway 601 South, Map/PIN 5543-96-1540, from I-X <br />to I-1. <br /> <br />ZONING TEXT AMENDMENTS <br /> <br />Petition 88-07. Staff Request. 5.10, Screening Requirements. Tabled <br />at June 20, 1988 meeting. The attached has been changed from 10' opaque <br />fences with vegetative screening to 6' opaque fences with vegetative <br />screening. The Planning Board voted 5-0 to approve the original <br />petition. <br /> <br /> Mr. Bill Powlas, owner of Bill's Junk Car Service, objected to the <br />proposed amendment, stating opaque fences are too expensive. He complained <br />that the County was discriminating against junk yard owners. <br /> Mr. Ken McGee, owner of K & C Auto Salvage located on Highway 49 and <br />Pharr Mill Road, opposed the opaque fencing requirement. <br />Ms. Linda Rankin, resident of Pharr Mill Road, supported the opaque <br />fencing requirement and complained of the appearance of K & C Auto Salvage. <br /> Mr. Morris Hart, owner of salvage yard on Stough Road, spoke in support <br />of fencing but commented that the salvage yard owners should be given time to <br />meet this requirement due to the expense of installing fencing. <br /> Chairman Lentz closed that portion of the public hearing regarding <br />Petition 88-07. <br /> Motion was made by Commissioner Payne and seconded by Chairman Lentz to <br />approve Petition 88-07 as recommended by the Planning Board. No vote was <br />taken on this motion. <br /> A substitute motion was made by Commissioner Moss and seconded by <br />Commissioner Hamby to approve a six-foot fence with vegetative screening on <br />the outside, to leave out the opaque fencing, and to give the owners a three- <br />year period to have the vegetation on the outside of the fencing which is to <br />be located on those sides of the salvage yard that can be seen by the public. <br />This motion failed with Commissioners Moss and Hamby voting for and Commis- <br />sioners Melvin and Payne and Chairman Lentz voting against. <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Hamby and <br />unanimously carried, the Board tabled Petition 88-07 regarding salvage yard <br /> <br /> <br />
