498 The Board of Commissioners of the County of Cabarrus met in regular session at the County Courthouse in Concord, North Carolina, on Monday, October 3, 1988, at 3:00 P.M. Present - Chairman: James W. Lentz Commissioners: Kenneth F. Payne William G. Hamby, Jr. Martha H. Melvin R. Giles Moss UPON MOTION of Commissioner Melvin, seconded by Commissioner Payne and unanimously carried, the minutes of September 12 and September 19, 1988, were approved as written. UPON MOTION of Chairman Lentz, seconded by Commissioner Moss and unanimously carried, the Board set a public hearing on Monday, October 24, 1988, at 4:00 P.M. or as soon thereafter as the public may be heard, on the adoption of a proposed supplement to the Cabarrus County Fire Code estab- lishing a Fire Code Permits System in Cabarrus County. UPON MOTION of Commissioner Melvin, seconded by Commissioner Payne and unanimously carried, the Board approved the sale of the Ambulance Service Substation property as described below for the sum of $59,225.00 to the North Carolina Department of Transportation for the purpose of constructing a highway designated as State Highway Project 8.1660201 and approved the "Special Provisions Covering Negotiated Sale and Removal of Buildings and Other Improvements from the Right of Way" whereby the County agreed to remove the metal building, flag pole, and outdoor light pole from the property within 45 days after receiving written notification from the Department of Transportation and to deposit $300.00 with the Department of Transportation as a "Performance Deposit" to insure the removal of the improvements. The Board authorized the Chairman to execute the Deed between the County and the Department of Transportation and to execute the "Special Provisions Covering Negotiated Sale and Removal of Buildings and Other Improvements from the Right of Way" on behalf of Cabarrus County. LEGAL DESCRIPTION OF PROPERTY BEGINNING at a point on the western property line of the under- signed, a common property line with Rufus J. Lankford, now or formerly, said point being 105 ft. northwest of and normal to Survey Line Y (NC Highway 49); thence in a northeasterly direction 105 ft. northwest of and parallel to Survey Line Y (NC Highway 49) to a point located 80 ft. west of and normal to Survey Station 40+15, Survey Line L Rev. (US Highway 601); thence in a northeasterly direction in a straight line toward a point located 52.20 ft. west of and normal to Survey Station 42+21.07, Survey Line L Rev. to a point of intersection with the northern property line of the undersigned, a common property line of Thomas F. Joyner, et al, now or formerly; thence N-83o23'-E along the northern property line of the undersigned to the point of intersection with Survey Line L Rev. (US Highway 601); thence in a southerly direction along Survey Line L Rev. to the point of intersection with Survey Line Y (NC Highway 49), said point of intersection being at Survey Station 39+13.88, Survey Line L Rev., being equal to Survey Station 171+91.74, Survey Line Y; thence in a westerly direction along Survey Line Y to the point of intersection with the western property line of the under- signed, if extended; thence in a northerly direction along the western property line, if extended, and the western property line of the undersigned to the point of BEGINNING. UPON MOTION of Chairman Lentz, seconded by Commissioner Hamby and unanimously carried, the Board approved the following Health Department budget amendments.
