12 <br /> <br /> In accordance with the charges, terms and conditions contained in this <br />agreement, TMA agrees to furnish NCGS (North Carolina General Statutes) <br />audit services on a reasonable sample of' the Countyts business personal <br />property taxpayers. Audits will be performed in compliance with all <br />statutes applicable within the N.C. Machinery Act, specifically; NCGS <br />105-283, Uniform Appraisal Standards; NCGS 105-317.1, Appraisal Elements <br />for Reconciling to True Value; and NCGS 105-312, "Discovered Property" <br />Procedures. Customer shall receive two (2) copies of valuation report in <br />the format agreed upon. Customer shall pay all charges due under the <br />schedules in effect. <br /> <br />2. TERM OF AGREEMENT <br /> This Agreement shall become effective from the date of its acceptance <br />by TMA and shall remain in effect for an initial term of thirty six (36) <br />months and shall continue in effect thereafter on a month-to-month basis <br />cancellable by either party upon thirty (30) days written notice. <br /> <br />3. CHARGES <br />For services furnished by TMA under this Agreement, customer shall pay to <br /> <br /> A. Schedule: 35% of taxes discovered including penalty. <br /> B. Time: 25% - After notice of discovery to taxpayer <br /> 25% - After local appeal right is exhausted. <br /> 50% At time of payment from taxpayer or by last day <br /> taxpayer can pay bill without interest, whichever <br /> occurs first. <br /> Ail invoices shall be due and payable in full upon receipt. Ail <br />amounts not paid within thirty (30) days after date of invoice are subject <br />to a finance charge on the unpaid amount at the rate of one and one-half <br />percent (1 1/2%) per month (annual percentage rate eighteen percent (18%)). <br /> <br />4. INDEMNIFICATION <br /> Customer agrees that proprietary rights to the business personal <br />property audit system shall remain with TMA and that customer will not sell <br />or lease the system to any other person, company, or taxing jurisdiction or <br />permit access to the system except for employees of the customer authorized <br />to do so by TMA. <br /> <br />5. GENERAL <br /> The Agreement will be governed by the laws of the State of North <br />Carolina. <br /> The customer acknowledges that he has read this agreement, understands <br />it, and agrees to be bound by its terms and conditions. <br /> <br />6. NOTICES <br /> Notices to be given or submitted by either party to the other, <br />pursuant to this agreement, shall be sufficiently given or made in writing <br />and sent by certified mail, postage prepaid. <br /> <br />ACCEPTED: TAX MANAGEMENT ASSOCIATES, INC. <br />Authorized <br />Signature /s/ Richard H. Rowland <br />Title Assessor <br /> <br />Date 5/4/88 Date May 3, 1988 <br /> <br /> The Board reviewed the letter from Mr. Hugh Price, District <br />Conservationist, asking that Mr. Jerry Hammill be reappointed to a new term <br />as watershed commissioner. In his letter, Mr. Price indicated that during <br />his first term of office Mr. Hammill showed a high amount of interest in <br />the watershed program, used much of his personal time and expenses to carry <br />out watershed activities, made on-site visits to the stream work on a <br />regular basis, and encouraged the active participation of others. <br /> UPON MOTION of Commissioner Melvin, seconded by Chairman Lentz and <br />unanimously carried, the Board reappointed Mr. Jerry Hammill to the <br />Watershed Improvement Commission for a second six-year term due to his <br />extraordinary service during his first term of office. Mr. Hammill's <br />second term of appointment will expire on February 15, 1995. <br /> <br /> <br />
