65 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in <br />regular session at the County Courthouse in Concord, North Carolina, on <br />Monday, March 20, 1989, at 7:00 P.M. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: R. Giles Moss <br /> William G. Hamby, Jr. <br /> Martha H. Melvin <br /> Billy J. Simmons, Jr. <br /> The invocation was given by Reverend John A. Coad of the Associate <br />Reformed Presbyterian Church. <br /> Chairman Lentz stated that this was the date and hour scheduled <br />for a public hearing on a proposed Zoning Text Amendment. Mr. Mike <br />Byrd, member of the County Planning staff, presented the proposed <br />amendment to the Board. <br /> <br />ZONING TEXT AMENDMENT <br />(1) Petition 89-01. Planning Staff Request. <br /> Overlay District (WSO). <br /> <br />Section 3.12, Watershed <br /> <br />The Planning Board voted 5-0 to approve this revision. <br /> <br /> There was no one present to speak either for or against the <br />proposed amendment, and the public hearing on Petition 89-01 was <br />closed. <br /> UPON MOTION of Commissioner Melvin, seconded by Commissioner Hamby <br />and unanimously carried, the Board approved Petition 89-01 to amend <br />Section 3.12, Watershed Overlay (WSO) District, as follows: <br /> <br />Delete Coldwater Creek from the listed watersheds. <br />After "Shall meet the following requirement": <br />Delete in number 1. "When served by individual wells or <br /> septic tanks" <br />Delete in number 2. "When served by individual wells or <br /> septic tanks" <br />Delete number 3 totally.' <br /> <br /> Mr. William G. Alexander, attorney representing the investors of <br />Dogwood Partners I, spoke in support of the proposed resolution <br />requesting a study of a new alignment of the West-Side By-Pass which <br />would allow the development of a new subdivision. He also reported <br />that the Kannapolis City Council had adopted a similar resolution at <br />its meeting on March 16, 1989. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Melvin <br />and unanimously carried, the Board adopted the following Resolution. <br /> <br /> A RESOLUTION ENDORSING THE PROPOSED <br />ALIGNMENTS OF THE KANLACON WEST-SIDE BY-PASS <br /> <br />WHEREAS, <br /> <br />the Board of Commissioners of the County of Cabarrus is aware <br />of the increasing urbanization of Cabarrus County and its <br />municipalities; and the impact on existing transportation <br />facilities; and <br /> <br />WHEREAS, <br /> <br />said Board endorses the construction of the West-Side By-Pass <br />as scheduled in the North Carolina Transportation Improvement <br />Program; and <br /> <br />WHEREAS, <br /> <br />the North Carolina Department of Transportation has <br />established feasible alignments for the proposed Kanlacon <br />West-Side By-Pass. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of <br />Cabarrus County, by this Resolution, informs the North Carolina <br />Department of Transportation that feasible alignments for the northern <br />leg of the proposed Kanlacon West-Side By-Pass, shown as Alternate 1 <br />and Alternate 2 on the Department of Transportation Project Map U-2009, <br />are fully acceptable to the Board of Commissioners. <br /> <br /> BE IT FURTHER RESOLVED, that the Board of Commissioners of <br />Cabarrus County encourages the North Carolina Department of <br />Transportation to consider a fifth alternate route for the northern leg <br /> <br /> <br />
