87 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in recessed <br />session at the County Courthouse in Concord, North Carolina on Wednesday, <br />April 19, 1989, at 5:00 P.M. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: R. Giles Moss <br /> William G. Hamby, Jr. <br /> Martha H. Melvin <br /> Billy J. Simmons, Jr. <br /> Also present were the following members of the Concord Board of Aldermen: <br />Mayor Bernie Edwards, Mayor Pro-Tem James L. Dorton and Aldermen T. Laine <br />Harling, Robert L. Mathis, Jr., Lamar Barrier, Wilson F. Cone, Jr., and Dr. <br />Hector H. Henry. <br /> The invocation was given by Alderman Cone. <br /> Chairman Lentz and Mayor Edwards called to order the joint meeting of the <br />Board of Commissioners and the Board of Aldermen. They announced that the two <br />boards had reached an agreement relative to the Coddle Creek Reservoir Project <br />and were meeting at this time to finalize the matter. <br /> Motion was made by Alderman Henry and seconded by Alderman Mathis to <br />approve the "Agreement to Supply Treated Water" between the City of Concord and <br />Cabarrus County. The motion was approved unanimously. <br /> Motion was made by Mayor Pro-Tem Dorton and seconded by Alderman Barrier <br />to approve the "Agreement Relative to the Construction, Operation and Maintenance <br />of a Water Supply Reservoir" between the City of Concord and Cabarrus County. <br />The motion was unanimously carried. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Moss and <br />unanimously carried, the Board approved the following Agreement between the City <br />of Concord and Cabarrus County. <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />AGREEMENT RELATIVE TO THE CONSTRUCTION, <br /> OPERATION AND MAINTENANCE OF <br /> A WATER SUPPLY RESERVOIR <br /> <br /> THIS AGREEMENT of Interlocal Cooperation, pursuant to Article 20 of Chapter <br />160A of the General Statutes of North Carolina, made and entered into this 19 <br />day of April, 1989, by and between the CITY OF CONCORD, North Carolina <br />(hereinafter referred to as "CONCORD"), and CABARRUS COUNTY (hereinafter referred <br />to as "CABARRUS"); ~ <br /> <br />W I T N E S S E T H: that <br /> <br /> WHEREAS, CONCORD and CABARRUS agree that it is mutually beneficial for <br />CABARRUS to construct, operate and maintain a dam, lake and watershed in Cabarrus <br />County, North Carolina, on Coddle Creek of approximately 1,900 acres, more or <br />less (hereinafter referred to as the "Reservoir"), in order to provide and supply <br />an additional source of raw water for the residents of the greater Cabarrus <br />County area; and <br /> <br /> WHEREAS, CONCORD: (a) currently owns and operates a 10 million gallon per <br />day (MGD) capacity raw water pumping station along Coddle Creek (the "Existing <br />Pump Station") in or about the site of the Reservoir from which it currently <br />draws raw water for use in its municipal water system through an existing 24- <br />inch raw water transmission line (the "Existing Raw Water Line") leading to its <br />Hillgrove Water Filter Plant ("Hillgrove"); (b) currently owns approximately <br />513.8173 acres of land in or about the Reservoir, more particularly described <br />in "Exhibit A" attached hereto and incorporated herein by reference (the "Concord <br />Real Property"); (c) has previously employed Peirson and Whitman, Inc., to <br />prepare plans and specifications and surveys and to perform other engineering <br />activities for the development of the Reservoir, or otherwise, and also has <br />secured appraisals for the real property involved, all of which are more <br />particularly identified in "Exhibit B" attached hereto and incorporated herein <br />by reference (the "Concord Plans and Documents"); and (d) has previously <br />forwarded Notice of Intent to File Condemnation Action under G.S. 40A-40 to other <br />landowners in the vicinity of the Reservoir whose property has not yet been <br />acquired by CONCORD or CABARRUS, a listing of such landowners being attached <br />hereto marked "Exhibit C" and incorporated herein by reference; and <br /> <br /> <br />
