172 <br /> <br /> The Board of Commissioners for the County of Cabarrus met in regular <br />session at the County Courthouse in Concord, North Carolina, on Monday, August <br />7, 1989, at 7:00 P.M. <br /> Present - Chairman: James W. Lentz <br /> Commissioners: R. Giles Moss <br /> William G. Hamby, Jr. <br /> Martha H. Melvin <br /> Billy J. Simmons, Jr. <br /> The invocation was given by Mr. Henry Waldroup, Superintendent of Water <br />and Sewer. <br /> UPON MOTION of Commissioner Moss, seconded by Commissioner Hamby and <br />unanimously carried, the minutes of July 13, 1989 were approved as written. <br /> <br />NEW BUSINESS CONSENT <br /> <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Moss and <br />unanimously carried, the Board approved the following contract between Cabarrus <br />County, by and through the Parks and Recreation Department, and Cannon Memorial <br />Young Men's Christian Association and Community Center, Inc. <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />CONTRACT <br /> <br /> THIS CONTRACT, made by and between Cabarrus County, hereinafter referred <br />to as the "County", by and through its Parks and Recreation Department, and <br />Cannon Memorial Young Men's Christian Association and Community Center, Inc., <br />hereinafter referred to as "Cannon YMCA"; <br /> W I T N E S S E T H: that -- <br /> WHEREAS, Cannon YMCA operates and provides programs and services for senior <br />citizens of Cabarrus County, and is properly incorporated in the State of North <br />Carolina for this purpose; and <br /> WHEREAS, Cannon YMCA wishes to secure the continued financial support of <br />the County for a portion of the costs incurred in providing these services; and <br /> WHEREAS, the County, in the interest of the welfare of its citizens, <br />desires to provide financial support for a portion of the costs incurred by <br />Cannon YMCA in its provision of these services; and <br /> WHEREAS, the County has appropriated the sum of $7,000.00 for this purpose <br />for the period July 1, 1989, through June 30, 1990. <br /> NOW, THEREFORE, in consideration of the premises, County and Cannon YMCA <br />do mutually agree to the following terms and conditions: <br /> 1. This contract shall begin July 1, 1989, and shall exist and continue <br />through June 30, 1990. <br /> 2. Cannon YMCA shall provide its services to individuals who qualify for <br />these services in relation to Cannon YMCA's established policies in a manner <br />specified by these policies. These policies are understood to provide for <br />compliance with Titles VI and VII of the Civil Rights Act of 1964 and Section <br />504 of the Rehabilitation Act of 1973, as appropriate, in addition to any other <br />local ordinances, state laws, and federal regulations which may be applicable <br />to Cannon YMCA and its services. <br /> 3. The County shall allocate and, upon receipt of an invoice therefore, <br />pay to Cannon YMCA twelve (12) monthly payments of $583.33 each, commencing July, <br />1989, for a total of $7,000.00, with each payment to be made on or about the last <br />day of each month. <br /> 4. Cannon YMCA will undergo an audit of its operations conducted by a <br />Certified Public Accountant and will submit a copy of the report of this audit <br />to the Parks and Recreation Department within ninety (90) days of the conclusion <br />of Cannon YMCA's established fiscal year. <br /> 5. Cannon YMCA agrees to hold the County and the Parks and Recreation <br />Department harmless for any and all liability, damages or claims, including <br />attorney's fees, that might be asserted or suffered by the County or the Parks <br />and Recreation Department as a result of any act or omission of any of Cannon <br />YMCA's officers, employees, agents or representatives arising out of this <br />contract. <br /> 6. This contract may be terminated by either party upon thirty (30) days <br />prior written notice to the other party. <br /> IN WITNESS WHEREOF, the parties have caused this agreement to be executed <br />upon authority duly given. <br /> <br /> <br />
