194 <br /> <br /> IN TESTIMONY WHEREOF, the parties have caused this agreement <br />to be duly executed by their authorized officers pursuant to <br />resolutions adopted in accordance with law. <br /> <br />ATTEST: <br /> <br />CABARRUS COUNTY <br />By: <br /> <br />Chairman of the Board <br />of County Commissioners <br /> <br />Clerk <br /> <br />ATTEST: <br /> <br />CABARRUS ARTS COUNCIL, INC. <br />By: <br /> <br />President <br /> <br />Secretary <br /> <br /> This instrument has been pre-audited in the manner required <br />by the Local Government Budget and Fiscal Control Act. <br /> <br />By: <br /> <br />County Finance Officer <br /> <br />Date: <br /> <br /> UPON MOTION of Chairman Lentz, seconded by Commissioner Simmons and <br />unanimously carried, the Board approved the following contract between Cabarrus <br />County and the Piedmont Farmers Market, Inc. for Fiscal Year 1989-1990 and <br />authorized Chairman Lentz to execute the contract on behalf of Cabarrus County. <br /> <br />NORTH CAROLINA <br /> <br />CABARRUS COUNTY <br /> <br />CONTRACT <br /> <br /> THIS CONTRACT, made and entered into effective the 1st day of <br />July, 1989, by and between CABARRUS COUNTY, a body politic and <br />political subdivision of the State of North Carolina, hereinafter <br />referred to as the "COUNTY", and the PIEDMONT FARMERS MARKET, INC., <br />a non-profit corporation of Cabarrus County, North Carolina, <br />hereinafter referred to as the "FARMERS MARKET"; <br /> W I T N E S S E T H: that -- <br /> WHEREAS, FARMERS MARKET is a not-for-profit corporation <br />established with the assistance of the Agricultural Extension <br />Service to provide a facility at which farmers located in the area <br />of Cabarrus County, North Carolina, may sell and the public may <br />purchase fresh fruits and vegetables directly from the producers; <br />and <br /> WHEREAS, COUNTY and FARMERS MARKET desire to enter into a <br />contract whereby FARMERS MARKET will further develop the site of its <br />operation with grading, gravel and landscaping; and <br /> WHEREAS, FARMERS MARKET desires to obtain the financial <br />support of COUNTY for a portion of its operating expenses and in the <br />interests and welfare of its citizens, COUNTY desires to provide <br />financial support for a portion of the expenses incurred by FARMERS <br />MARKET; and <br /> WHEREAS, COUNTY is authorized to make contributions to FARMERS <br />MARKET under the provisions of G. S. 153A-149(c)(2), and Article 52 <br />of Chapter 106 of the General Statutes of North Carolina (NCGS 106- <br />580 through 600); and <br /> WHEREAS, COUNTY has appropriated the sum of Five Thousand <br />Dollars ($5,000.00) for this purpose for the period July 1, 1989- <br />June 30, 1990. <br /> NOW, THEREFORE, in consideration of the premises, COUNTY and <br />FARMERS MARKET do mutually agree to the following terms and <br />conditions: <br /> 1. This contract shall begin July 1, 1989, and shall exist <br />and continue through June 30, 1990. <br /> 2. FARMERS MARKET shall gravel, grade and landscape the site <br />of the Piedmont Farmers Market and will operate the market for the <br /> <br /> <br />
