221 The Board of Commissioners for the County of Cabarrus met in regular session at the County Courthouse in Concord, North Carolina on Monday, October 16, 1989, at 7:00 P.M. Present - Chairman: James W. Lentz Commissioners: R. Giles Moss William G. Hamby, Jr. Martha H. Melvin Billy J. Simmons, Jr. Commissioner Simmons was absent for the beginning of the meeting. The invocation was given by Reverend F. Donald Beatty of the Central United Methodist Church. UPON MOTION of Commissioner Moss, seconded by Commissioner Hamby with Commissioners Moss, Hamby, and Melvin and Chairman Lentz voting for, the minutes of September 25, October 2, and October 4, 1989 were approved as written. Chairman Lentz announced that the public hearing scheduled for Zoning Text Petition 89-02 (Section 4.12, "Subdivision Lot Size Reduction") and Subdivision Regulations Text Petition 89-02 (Section 4.9, Number 14, "Roads") would not be held on this date. He explained that the public hearing notice sent to the local newspapers had been lost in the mail and therefore not publicized as required. A public hearing for these petitions will be held on November 20. Dr. Nancy Randall, Chairman of the Cabarrus County Planning Board, reviewed Zoning Text Petition 89-03, Sign Regulations, for which a public hearing was held on July 24, 1989. The regulations had also been discussed in a joint work session by the Board of Commissioners and Planning Board on August 16, 1989. The Petition as recommended by the Planning Board was as follows. Petition 89-03. Planning Staff (by request of the Cabarrus County Planning Board and Zoning Board of Adjustment), amend Section 5.6 "Sign Regulations" In addition, the following changes are required to reconcile the sign regulation changes to the remainder of the Zoning Ordinance: a. Amend Section 16 "Definitions", page 128, by deleting the word "sign" from the definition of "s tructure". b. Amend Section 3.2-4 "Schedule of Use Regulations", page ll-J, by deleting the line item for "Signs (Advertising)" c. Amend Section 3.2-4 "Schedule of Use Regulations", page ll-J, to change the line item for "Signs (Off- Premise)" to not permit these signs in the C-3 zoning district. The Planning Board voted 5-0 to approve this petition. Chairman Lentz asked if anyone were present who wished to speak for or against the Petition 89-03. Mr. Bill Powlas, owner of Bill's Junk Car Service, asked if his advertising sign could remain as it currently stands. Mr. Michael M. Ruffin, County Manager, pointed out that Mr. Powlas' sign would be considered a non- conforming sign under the proposed regulations and would be permitted to remain as long as Mr. Powlas maintains the sign in its current condition. However, it was noted by Chairman Lentz that Mr. Powlas' sign would be subject to any future revisions to the sign regulations. There being no one else to speak regarding Petition 89-02, Chairman Lentz closed the public hearing. UPON MOTION of Commissioner Hamby, seconded by Commissioner Melvin with Commissioners Hamby, Melvin, and Moss and Chairman Lentz voting for, the Board approved Petition 89-03 amending Section 5.6 "Sign Regulations" of the Cabarrus County Zoning Ordinance as recommended by the Planning Board. Section 5.6 "Sign Regulations" is contained in the Cabarrus County Ordinance Book and is hereby included by reference as a part of the minutes. The Board further approved the following changes to reconcile the sign regulation changes to the remainder of the Zoning Ordinance: a. Amend Section 16 "Definitions", page 128, by deleting the word "sign" from the definition of "structure". b. Amend Section 3.2-4 "Schedule of Use Regulations", page ll- J, by deleting the line item for "Signs (Advertising)" c. Amend Section 3.2-4 "Schedule of Use Regulations", page 11-
